Court Declares Election Dispute Petition for West Java 2 Inadmissible

JAKARTA (MKRI) — The Constitutional Court (MK) rules to declare the case concerning the Election Results Dispute (PHPU) for the 2024 Regional Representatives Council (DPRD) candidate election in West Java is inadmissible. Case No 124-02-05-12/PHPU.DPR-DPRD-XXII/2024 was petitioned by Agus, a candidate for the West Java Provincial DPRD for the 2024 election in Jabar 2.

“[The Court] declares the Petitioner’s petition inadmissible,” stated Chief Justice Suhartoyo during the session held on Tuesday, May 21 2024 in the plenary courtroom.

In the ruling delivered by Constitutional Justice Daniel Yusmic P. Foekh, the Court declared that it had lawfully and properly summoned the Petitioner with a letter from the Chief Registrar dated April 25, 2024, regarding the Hearing Summons. However, the Petitioner was absent without valid reasons by the end of the hearing.

“Based on the legal facts referred to in section d and the provisions referred to in section e above, the Justice Deliberation Meeting on May 15, 2024 concluded that the Petitioner’s absence at the panel preliminary hearing without a valid reason, despite lawful and proper summons, showed that the Petitioner did not file the a quo petition seriously. As such, the Petitioner’s petition must be declared inadmissible,” Daniel stated.

Constitutional Justice Foekh added that the Court deemed it unnecessary to hold another session to hear the responses of the Respondent, the Relevant Party, and Bawaslu (Elections Supervisory Body) since they would be irrelevant. As such, those responses and the evidence were not considered any further.

Previously, in case No 124-02-05-12/PHPU.DPR-DPRD-XXII/2024, the petitioner stated that the votes in several electoral districts such as Cikalong Wetan, Cipendey, and Cipatat Subdistricts did not match the vote counts from their respective polling stations.
