KPU Refutes Gerindra’s Allegation in West Lampung 2

The Constitutional Court (MK) is holding another hearing no. 215-01-02-08/PHPU.DPR-DPRD-XXII/2024 on the 2024 Legislative Election Results Dispute (PHPU) in Panel 3 Hearing Room presided over by Constitutional Justice Arief Hidayat accompanied by Constitutional Justices Anwar Usman and Enny Nurbaningsih, Tuesday (5/14/2024). JAKARTA (MKRI) - The General Election Commission (KPU) requested the Constitutional Court (MK) to dismiss all requests filed by the Great Indonesia Movement Party (Gerindra). This was stated by Imamul Muttaqin representing the KPU (Respondent) in a hearing presided over by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justices Anwar Usman and Enny Nurbaningsih. The Case No. 215-01-02-08/PHPU.DPR-DPRD-XXII/2024 was filed by the Gerindra.

"In essence of petition, dismissing the Petitioner's request in its entirety," stated Imamul Muttaqin during the hearing held in Panel 3 on Tuesday (5/14/2024).

Rebuttal for Bandar Lampung 3

KPU stated that the reduction in the Petitioner's vote acquisition at Polling Stations (TPS) 1 and 7 in Bilabong Jaya Sub-District, Langkapura District, was due to several factors. First, some voters used Form C notifications belonging to others. Second, there were messy voter administrative data. Third, there were relocated voters given five types of ballot papers.

Regarding the Petitioner's claim of phantom voters with Resident ID cards (KTP) in the name of Agus Rudiyanto who did not vote at TPS 1 in Bilabong Jaya, the Respondent explained that according to the Chairperson of the polling committee (PPS) of TPS 1, Syafandi, who is also the Head of Neighbourhood in the area, Agus Rudiyanto did not reside at the address stated on the KTP, and the house was empty. Currently, Agus Rudiyanto resides in Teluk. On election day, February 14, 2024, Agus Rudiyanto came to the TPS as a Special Voter List (DPK) holder, presenting and submitting his original electronic KTP to the PPS officers. The KTP was then photocopied using the available equipment at the TPS by the PPS officers, and Agus Rudiyanto signed the attendance list for voters using the KTP.

Voters in Metro 3

Regarding voters in Metro District 3, according to the KPU, the Petitioner's claim that seven voters residing and registered as voters on the final voter list (DPT) outside Yosodadi Sub-District, as well as two voters with Resident ID Number (NIK) codes from outside East Metro Sub-District who were not registered in the DPT but voted at TPS 17 in Yosodadi Sub-District, is incorrect. KPU explained that these voters had moved their domicile to Metro City, in Yosodadi Sub-District. This is in accordance with the technical guidelines of KPU Decree No. 66 of 2024, page 43, letter p, on technical guidelines for the implementation of voting and vote counting in elections.

Furthermore, the Petitioner's claim of five voters who should not have been eligible to vote at TPS 023 in Yosodadi Sub-District because they resided and were registered as voters in the DPT outside Yosodadi Sub-District, East Metro Sub-District, is also incorrect. KPU explained that these voters had moved their domicile to Metro City, Yosodadi Sub-District.

West Lampung Regency DPRD Election in West Lampung 2

Regarding the filling of membership in the West Lampung District DPRD West Lampung Electoral District (Dapil) 2, according to the KPU, the Petitioner's claim regarding alleged vote mobilization by certain polling station working committee (KPPS) personnel using Form C notifications belonging to undistributed voters to win legislative candidates from certain parties is untrue. Before election day, KPPS had distributed Form C notifications to the public. Out of 174 DPT and Form C notifications available, 172 sheets had been delivered to voters and/or their families, while 2 sheets remained undistributed.

On Wednesday, February 14, 2024, KPPS TPS 5 in Pekon Hujung, Belalau District, was opened at 07:00 WIB. The activities began with the swearing-in of KPPS members, followed by the reading of rules of conduct inside the TPS, and the opening of the ballot box attended by political party witnesses and electoral participants with 6 people as well as TPS supervisors.

Based on the explanations provided, KPU requested the Court to accept and grant all exceptions of the Respondent, and in essence, dismiss all requests of the Petitioner and affirm the correctness of KPU Decree No. 360 of 2024.

Meanwhile, in its statement, the Election Supervisory Board (Bawaslu) stated that the vote count stipulated by the Respondent was correct and in accordance with Bawaslu's findings.

No Incidents

In this matter, there is a Relevant Party, identified as the Prosperous Justice Party (PKS). The Relevant Party conveyed that the organizers at the level of TPS 1 and TPS 7 of Bilabong Jaya Urban Village, Langkapura District, Bandar Lampung City, did not record specific incidents related to the Petitioner’s petition as stated on pages 5 to 11. In addition, the Petition’s witnesses did not raise objections in the Special Incident Model C Form and/or Witness Objections. Therefore, it must be considered that the Petition has accepted the vote count results at TPS 1 and TPS 7.

"That because the organizers at the level of TPS 1 and TPS 7 of Bilabong Jaya Urban Village, Langkapura District, Bandar Lampung City, did not record specific incidents related to the Petitioner’s petition as stated on pages 5 to 11, and the Petition’s witnesses did not raise objections in the Special Incident Model C Form and/or Witness Objections, it must therefore be considered that the Petition has accepted the vote count results at TPS 1 and TPS 7," Sulthan representing PKS emphasized."
