KPU: PAN’s Claim of Vote Reduction Not Supported by Evidence

JAKARTA (MKRI) — The General Elections Commission (KPU) said that the National Mandate Party (PAN) could not prove the arguments for alleged fraudulent practices and/or violations of vote reduction in the electoral district of Yahukimo 3 in Papua Pegunungan Province. Thus, according to the KPU as Respondent, the Petitioner’s argument that its votes were lost during the regency-level recapitulation was not supported by valid evidence.

“The Petitioner cannot prove its argument that it obtained 5,317 valid votes in Yahukimo 3 because it is not supported by valid evidence and voting in Yahukimo 3, which was carried out with noken based on the plenary meeting of the recapitulation of the vote count results at the district-level, determined that the Petitioner’s vote was zero,” said the Respondent’s legal counsel Setiyo Hermawan in response to case No. 240-01-12-37/PHPU.DPR-DPRD-XXII/2024 on the 2024 legislative election results dispute in the plenary courtroom on Tuesday, May 14, 2024. This case was heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on Panel 1.

Meanwhile, Bawaslu (Elections Supervisory Body) did not find any alleged violations in Papua Pegunungan Province or Yahukimo Regency as argued by PAN. However, it said that the chairpersons of the KPU and district election committee (PPD) of Mugi had worked together to transfer PAN’s votes with a total of 5,240 votes for Amsal Siep and votes for the Labor Party, PPP (United Development Party), and Garuda (Indonesian Guard of Change Party) were unilaterally transferred to candidates from the National Democratic Party (NasDem) by the community.

In its petitum, the Petitioner asks the Court to annul the KPU Decree No. 360 of 2024 on the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide on March 20, 2024 at 22:19 WIB as it pertains the electoral district of Yahukimo 3 in Mugi District, Yahukimo Regency, Papua Pegunungan Province. The Petitioner also asks the Court to determine the correct and legally valid results of: the Petitioner’s votes at a total of 5,213 votes for Yahukimo 3 and PAN’s at 7,386 votes in the Yakihimo Regency DPRD election.
