JAKARTA (MKRI) — The Constitutional Court (MK) held a hearing on the Papua Pegunungan Provincial DPRD (Regional Legislative Council) for the electoral district of Tolikara 4 on Tuesday, May 14, 2024 in the plenary courtroom. The case No. 71-02-14-37/PHPU.DPR-DPRD-XXII/2024 was filed by Elpius Obama Tabo from the Democratic Party.
At a hearing chaired by Chief Justice Suhartoyo, the Respondent’s legal counsel Ana Rita Y. Ohee stated that the Tolikara Regency KPU (General Elections Commission) as Respondent had conducted an open plenary session in the Gundagi, Wina, Telenggeme, Woniki, Anawi Districts at the Grand Sartika Hotel in Wamena. The chairman of the district election committee (PPD) read out the district plenary session results for all elections.
“The session chairperson provided time for witnesses to object, but for the DPR election there were no witnesses who objected to the results. The witnesses only objected to the regency DPRD election. Then they provided time to Bawaslu but it did not object. Therefore, they ratified the results,” said Ohee explaining what happened when PPD had read out the election results.
She added that on March 1, 2024, the Tolikara Regency KPU conducted an open plenary session in Kai, Dow, Wari/Taiyeve II, Kembu, Wunin, Poganeri, Nelawi, Nunggawi, Geya, and Panaga Districts at the Horison Abepura Jayapura Hotel, where the PPD chair read out the district plenary session results for all elections. When the PPD had read out the results there were no witnesses who objected to the results. They only objected to the regency DPRD election results.
“There were delays of the recapitulation at the subdistrict/district level since due to excessive mobilization of masses disrupting public order, resulting in repeated postponement of the recapitulation process. Meanwhile, the Petitioner and other parties did not lodge objections according to the procedure stipulated in statutory laws and regulation. Additionally, during the recapitulation process in Tolikara Regency, there were no objections raised by witnesses,” he explained.

Meanwhile, Bawaslu, represented by Sanggup Abidin, said that in principle there were no reports and findings of violations by the Papua Pegunungan Provincial Bawaslu.
“In essence, the Petitioner argues that it lost 2,273 votes at 12 polling stations in Wakuwo District of Tolikara. The vote recapitulation in Wakuwo District showed that Elpius Obama Tabo from the Democratic Party received 0 votes and Yesman Kogoya from the Indonesian Democratic Party of Struggle (PDI-P) received 4,336 votes,” said Abidin.
