KPU: No PPP Votes Transferred to Garuda in North Sumatera

JAKARTA (MKRI) — The General Elections Commission (KPU) conveyed that there was no transfer of votes from the United Development Party/PPP (Petitioner) to the Indonesian Guard of Change Party (Garuda) and a reduction in the Petitioner's votes in North Sumatra Electoral District (Dapil) I, North Sumatra II and North Sumatra III. This was conveyed by Yuni Iswantoro representing the KPU as the Respondent for Case No. 187-01-17-02/PHPU.DPR-DPRD-XXII/2024. The second hearing was heard by Chief Justice Suhartoyo and Constitutional Justice Daniel Yusmic P. Foekh and M. Guntur Hamzah.

KPU said that the Petitioner's argument that there was a transfer of the Petitioner's votes to the Garuda as many as 4,987 votes in the North Sumatra I, 5,420 votes in the North Sumatra II, and 6,000 votes in the remaining North Sumatra III was incorrect and unfounded. KPU considers that the Petitioner did not clearly and completely convey at which stage the process of transferring the Petitioner’s votes to the Garuda occurred.

"The process of recapitulating vote counts is always carried out in stages starting from polling stations (TPS), subdistricts, regencies, provinces, and national. Therefore, the validity or stipulation of the general election results by the Respondent is based on the vote count which is carried out in stages starting from the polling stations, sub-districts, regencies/cities, provinces, and nationals, all of which processes have been regulated in Article 382 to Article 409 of the Election Law.  In fact, there was no transfer and reduction of the Petitioner's votes to the Garuda, either in the North Sumatra I, North Sumatra II, or North Sumatra III," said Yuni in a hearing held on Monday, May 13, 2024 in the plenary courtroom of the Constitutional Court.

In addition, continued Yuni, the Petitioner’s mandate witness had also affixed his signature to the process of stipulating the recapitulation of the vote results at the regency level for the North Sumatra I, North Sumatra II, and North Sumatra III.

Until the process of stipulating the results of the vote acquisition at the provincial level, there was also no transfer and reduction of the Petitioner's votes to the Garuda. During the recapitulation process of the vote count results at the North Sumatra Province level, the Petitioner’s mandate witness requested a recount. However, the Petitioner's mandate witness did not have valid evidence (the original obtained from the polling stations) to be compared with Respondent's C-results. Therefore, the Respondent could not fulfill the Petitioner’s request.

Meanwhile Bawaslu (Elections Supervisory Body), represented by M. Aswin Diapari Lubis, explained that the North Sumatra KPU as the leader of the session conveyed to all witnesses of election participants if there were objections to the recapitulation of vote counts to fill out Model D of special events or witness objections.

"And the PPP witness filled in Model D of a special incident or objection which essentially rejected the results of the open plenary meeting, the recapitulation of the vote count results at the North Sumatra Provincial level in the election which indicated the arrogant trial leader. Rejecting the results of recapitulation throughout the Nias islands, especially in South Nias Regency for all vote count results," he stressed.

Previously, in the preliminary hearing which was held on May 2, 2024, PPP argued that there was a transfer of the Petitioner's votes to the Garuda. He argued that in North Sumatra I, North Sumatra II, and North Sumatra III, North Sumatra Province, there had been a transfer of the Petitioner's (PPP) votes to the Garuda of 4,987 votes in the North Sumatra I, 5,420 votes in the North Sumatra II and 6,000 votes in the North Sumatra III, all of which were due to calculation errors by the Respondent.
