JAKARTA, MKRI – The Constitutional Court (MK) held a hearing on the 2024 Legislative election results dispute of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) on Wednesday, May 8, 2024. The hearing for case No. 78-01-04-34/PHPU.DPR-DPRD-XXII/2024 was filed by the Party of Functional Groups (Golkar). The hearing was presided over by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani on the Panel 2. 

The General Elections Commission (KPU) as Respondent through its legal counsel, Rizky Pramustiko, mentioned that Model C. DPR-PB Results at seven polling stations (TPS) in Weriagar District showed the vote dispute was only found at TPS 01 Weriagar, 02 Weriagar Induk, 01 Weriagar Baru. The total vote margin for Golkar was 42 votes and for the Indonesian Solidarity Party (PSI) was 100 votes.

Furthermore, Rizky also said that based on Model C. DPR-PB Results at six TPS in the Fafurwar District, the argument for vote disputes was not proven legally and convincingly. Therefore, it should be ruled out and not considered by the Court.

The Respondent highlighted that its actions were guided by the provisions outlined in Article 49 of KPU Regulation No. 5 of 2024. According to this regulation, if there is a discrepancy between the total votes at the TPS and the recapitulation of the vote count at the district level, the Petitioner has the right to submit a correction. However, the Respondent emphasized that the Petitioner had not filed any objections or recorded any incidents at any level, from the TPS level to the district and regency levels.

“So, the parties that won seats in the Provincial DPRD for the electoral district West Papua 3 are the Golkar Party with 11,971 votes, the Indonesian Democratic Party of Struggle (PDI-P) with 5,279 votes, the United Development Party (PPP) with 4,974 votes, the United Indonesia Party (Perindo) with 4,761 votes, and the National Democratic Party (NasDem) with 4,459 votes. Each of them obtained one seat, so there are a total of five seats for the Provincial DPRD for West Papua 3,” said Rizky before the Panel of Justices.
