JAKARTA, MKRI – The Constitutional Court (MK) held a follow-up hearing for the 2024 General Election of Members of the DPR and DPRD (PHPU DPR) submitted by the National Mandate Party (PAN), Case No. 246-01-12-06/PHPU.DPR-DPRD-XXII/2024, asked the Court to cancel the KPU's Decree No. 360 of 2024 regarding the filling of candidates for members of the DPR, Provincial DPRD/DPRA, Regency/City DPRD/DPRK in South Sumatra Province in the electoral district of Ogan Komering Ilir (OKI) 6 and Lahat 2, on Wednesday, May 8, 2024.
The hearing was heard by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih. The agenda of the hearing was to listen to the Respondent's KPU (General Elections Commission) answer, the Related Party's statement, and Bawaslu's statement, as well as the ratification of evidence.
KPU’s Response
The KPU responded to the Petitioner's argument that it lost 20 votes at polling station (TPS) 2 and TPS 3 of Tulung Harapan Village, Lempuing Subdistrict, Ogan Komering Ilir Regency. At the time of the plenary meeting to recapitulate the results at the Lempuing Sub-district level, the Petitioner's witness did not file an objection to the results of the sub-district level recapitulation regarding the vote acquisition at polling station 2 and 3 of Tulung Harapan Village. This is reinforced by evidence of Model D.Special Events and/or Witness Objections-KPU Lempuing District.
“If the Petitioner feels that he lost 20 votes at TPS 2 and TPS 3 of Tulung Harapan Village, Lempuing Subdistrict, Ogan Komering Ilir Regency, the Petitioner's witness should have filed an objection accompanied by evidence so that corrections can be made if the evidence is correct,” said the legal counsel for the KPU (Respondent), Istiarta Fajar Purnama.
Based on Model D. Special Events and/or Witnesses' Objections to the recapitulation of vote count results in Lempuing Jaya Sub-district, there were no notes or objections from the Petitioner's witnesses regarding the reduction of the Petitioner’s votes.
Therefore, the Respondent requests the Court to reject the Petitioner's in its entirety; declare as true the KPU Decree No. 360 of 2024, and determine the correct vote acquisition for the filling of membership of the Regency DPRD for Ogan Komering Ilir Electoral District 6.
PKB’s Response
The National Awakening Party (PKB) became a Relevant Party in this case. Emphasized that the PAN Party's Petition was vague and unclear. Through its legal counsel, Muhammad Athoilah.
“According to the Relevant Party, the petition is vague and unclear. The Petitioner did not specify which votes were lost. Is it the valid vote of the party, or which party candidate, or what number, or for which party. If the Petitioner feels that the vote count is correct, he should file an objection,” said Muhammad Athoilah.
PDI-P Response
(PDI-P) the Indonesian Democratic Party of Struggle, as a Relevant Party, stated that PAN's petition was unclear as to what it was asking the Court to do. The petitioner is unclear whether to request a recount or a re-vote. Both requests are not mentioned in the petition.
Bawaslu’s Response
In his statement, M Sarkani, representing Bawaslu, revealed that the report submitted by the Petitioner was not followed up because there were no things that met the criteria for violation.
M. Sarkani also explained that the report on the alleged transfer of PAN votes to PDI-P was not followed up, because the report did not contain violations.
