JAKARTA (MKRI) — The General Election Commission (KPU) denies that the election violations occurred at several polling stations (TPS) in Tomilito District election for DPRD Electoral District (Dapil) North Gorontalo Regency 2. This was conveyed by the KPU as the Respondent to the arguments for the legislative Election Results Dispute (PHPU) in Constitutional Court (MK) proposed by the Party of Functional Groups (Golkar).

"This argument is an incorrect argument because the objection of the Petitioner's mandate witness during the recapitulation in Tomilito District was based on the Petitioner's mandate witness not being careful when looking at the supporting documents for the DPTb (Additional Voter List)," said the Respondent's legal counsel, M Lazuardi Hasibuan in the Panel Courtroom on Wednesday (8/5/2024). The Hearing of Case No. 147-01-04-29/PHPU.DPR-DPRD-XXII/2024 was presided over by panel 2—Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani.

The KPU (Respondent) stated that there were four voters in the DPTb category at TPS 2 Tanjung Karang Village, not three voters. The four DPTb voters have been equipped with supporting documents as stated in the transfer voter attendance list. In addition, there were no objections from the Petitioner's mandate witnesses to the voting at the TPS

The KPU has affirmed that there are no voters with disabilities registered at TPS 2 in Bubode Village. Therefore, if the petitioner is alluding to a voter named Umar Enteno, it would be a significant error, as Umar Enteno is an elderly voter who is not listed as disabled.

The KPU said that Umar Enteno using his right to vote with the help of Nurhayati Bilontalo, his daughter-in-law. Nurhayati only took her to the voting booth and did not help voters in making their choice.

The KPU also explained the corrections had been made to errors in model C-Form Results during the recapitulation at the PPK (Subdistrict Election Committee) level in Tomilito District, witnessed by the Petitioner's witness, which was then outlined in the D-Form District Results and recorded in the Special Events D-Form. Failure to write numbers, letters, or words at TPS 1 in Bulango Village, TPS 1 and TPS 3 in Molantadu Village, as well as TPS 1 and TPS 2 in Tanjung Karang Village, does not change the vote results for the Golkar Party and other parties participating in the election.

Apart from that, the KPU denied it had not followed up on the North Gorontalo Regency Bawaslu's recommendation regarding alleged election violations. According to KPU, they have followed up on Bawaslu's recommendation.

The relevant party in this case is the United Development Party (PPP). Even though it is indirectly related to the arguments of Golkar's petition, PPP still registered as a Relevant Party and asked the Court to declare a revote at TPS 2 Tanjung Karang Village and determine the Golkar Party's vote acquisition at 1,164 votes and PPP at 1,181 votes.
