JAKARTA (MKRI) — The Constitutional Court (MK) again held a preliminary hearing in the legislative Election Results Dispute for Candidates of DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) on Tuesday (5/7/2024). The Petition registered with Case No. 249-01-16-31/PHPU.DPR-DPRD-XXII/2024. The case was petitioned by the United Indonesia Party (Perindo) led by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani on the Plenary Courtroom.
 

The General Elections Commission/KPU (Respondent) through James Simanjuntak stated that the argument at TPS 6, Urumessing Village, Nusaniwe District of 1 vote was incorrect. According to the Respondent, during the recapitulation plenary session at the Nusaniwe District level, it was found that the margin in Perindo's valid votes was recorded at 2 votes, bringing the total valid votes for parties and candidates to 64 votes.

"The results of the PPK investigation and the Panwascam's recommendation were to open the ballot boxes and recount the votes for the Provincial DPRD and indeed there was an error in recording the Perindo Party's vote acquisition, originally 2 votes, it should have been 1 vote, so that the total votes for parties and candidates, which was originally 64 votes, became 63 votes," said James at the hearing and listening to the Respondent's answers, statements from the Relevant Party, and Bawaslu.

No Evidence Yet

Meanwhile, according to a statement from Bawaslu for Maluku Province via Subair, the votes obtained by political parties in Maluku 1 were as follows: PKB received 10,724 votes, and Perindo received 10,727 votes. Observations by the Ambon City Bawaslu during the district/city-level recapitulation revealed evidence from the Petitioner's witnesses of vote shifting, consistent with the witnesses' statements.

"The Ambon City Bawaslu asked the Ambon City KPU to make improvements according to the applicable laws and regulations, and the KPU was given time to submit evidence regarding the objection. However, until the vote recapitulation was determined by the KPU, the Perindo Party had not submitted the relevant evidence." said Subair.
