KPU Responds to NasDem Claim in Pidie Jaya 3

JAKARTA (MKRI) — The Constitutional Court (MK) held a follow-up hearing for the election result dispute petition on case No. 54-01-05-01/PHPU.DPR-DPRD-XXII/2024, Tuesday (5/7/2024) at 07.00 PM WIB. The session was to hear the response from the KPU (General Elections Commission) as the Respondent, statements from relevant parties, testimony from Bawaslu (Elections Supervisory Body), and validation of evidence. The petition was filed by the National Democratic Party (NasDem) for the election of the DPR (House of Representatives), DPRD (Regional Legislative Council), Provincial DPRA (Aceh Legislative Council), and DPRK (Aceh Regency/City Legislative Council) of Pidie Jaya Regency, Aceh Province. The hearing was presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih, in Panel 3.

The KPU Arguments

The KPU’s legal counsel, Arief Effendi in the hearing said that the Respondent, in its exception, stated that the Petitioner did not argue that there was a reduction in the Petitioner's vote. Where the Petitioner, in its petition clearly stated that the Petitioner's vote acquisition was the same as the Respondent's recapitulation, which was 2,065 votes, it meant that there were no reduced votes for the Petitioner.

"In accordance with the Petitioner's statement, therefore the Petitioner's vote was not reduced, which basically means that there is no dispute between the Petitioner and the Respondent regarding the vote acquisition of the Petitioner," said Arief Effendi.

Therefore, the Petitioner has no legal standing to challenge the calculation of the Petitioner's votes based on the recapitulation conducted by the Respondent. Therefore, according to the Respondent, the Petitioner has no legal standing to submit a dispute over the election. Additionally, the Petitioner's petition is unclear.

Meanwhile, the Aceh Party, represented by legal counsel Ade Syamsul Falah, did not file an exception in the hearing. Ade stated that the vote acquisition of the Respondent was correct. The allegations of vote inflation for the Aceh Party were not true.

The Bawaslu Testimony

The voters supervisory committee (Panwaslih) of Aceh Province stated that on February 17, 2024, Panwaslih of Pidie Jaya Regency issued a directive to the Pidie Jaya PPK (subdistrict election committee) and its sub-districts. Essentially, the directive instructed the implementation of a recapitulation activity in the sub-district plenary meeting for all sub-districts of Pidie Jaya in accordance with legal provisions.

Then, on March 1, 2024, the Pidie Jaya Panwaslih received a report of election violations. In response to this report, the Pidie Jaya Panwaslih issued a Decree on March 13, 2024, instructing the Committee to conduct a recount of the calculations for DPRK candidates in Bandarbaru Sub-district based on the results from Form C at the polling stations.
