KPU Refutes Claims of Vote Inflation in East Kalimantan

JAKARTA (MKRI) — The Constitutional Court (MK) held a continued hearing of the 2024 General Election Results Dispute for members of the House of Representatives, Provincial Legislative Councils, and Regency/City Legislative Councils on Tuesday, May 7 2024. This second session for Case No 99-01-14-13/PHPU.DPR-DPRD-XXII/2024, petitioned by the Democratic Party (Democrat), presided over by Panel 2–Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani.
Petrus P. Ell, acting as legal counsel for the respondent (General Elections Commission, KPU), responded to the petitioner's claims, including addressing the addition of 366 votes for the National Mandate Party (PAN) and the reduction of 183 votes for the petitioner. "In regard to these claims, the respondent rejects them and states that they are not true. This is because the recapitulation process in filling the eighth seat for the House of Representatives in the East Kalimantan provincial electoral district has been conducted in accordance with the applicable regulations, starting from the polling stations, subdistricts, regencies, and we reject all the petitioner’s claims," stated Ell during the session that included hearing the respondent's response and the statements from the relevant parties and Bawaslu.

Meanwhile, Galeh Akbar Tanjung from East Kalimantan Bawaslu explained several input errors reported concerning the addition of PAN votes and the reduction of the petitioner's votes caused by discrepancies between the DPR Copy Result and the DPR Subdistrict Model Result in Berau Regency. Additionally, there were inconsistencies between the number of eligible voters and the number of valid and invalid votes, noted by the Biatan Subdistrict Elections Supervisory Committee. There was also a report about the addition of PAN votes at polling station (TPS) 03 in New Hope Village, Kuaro Subdistrict, during the subdistrict recapitulation process, where a discrepancy in the vote count between PAN and the petitioner was found. "Regarding the filling errors and corrections made during the vote acquisition recapitulation at the subdistrict level, the Indonesian United Development Party (PPP) did not create a special incident form because the political party witnesses present agreed and there were no objections," reported Galeh.
On this occasion, Rahmat and Nur Fadly Danial, legal counsel for PAN, read their statements regarding the claims in filling the membership of the House of Representatives in the East Kalimantan provincial electoral district. Essentially, the relevant party agrees with the respondent's decision as long as it pertains to the East Kalimantan provincial electoral district.
