KPU Denies Perindo’s Vote Margin in Central Maluku 2

JAKARTA (MKRI) — The Constitutional Court (MK) held a follow-up hearing over the 2024 election results dispute of DPR (House of Representatives) and Provincial/Regency/City DPRD (Regional Legislative Council) on Tuesday, May 7, 2024. The follow-up hearing for case No. 35-01-16-31/PHPU.DPR-DPRD-XXII/2024 was filed by the United Indonesia Party (Perindo) and presided over by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani on the Panel 2.

The Respondent's legal counsel Nurkhayat Santosa responded to the Petitioner's argument regarding the vote inflation to the Great Movement Party (Gerindra) by 51 votes and the Indonesian Democratic Party of Struggle (PDI-P) by 3 votes at polling stations (TPS) 1 to 8 of Sawai Village of North Seram Subdistrict is not true.  The number of the recapitulation votes of the subdistrict election committee (PPK) level contained in the D Results Subdistrict is the same. “Meanwhile, regarding the allegations of structured, systematic, and massive (TSM) violations during the recapitulation at the PPK of North Seram Subdistrict, the argument is also not true,” said Nurkhayat.

Recount

The Relevant Party’s legal counsel Rikardus Sihura responded to the arguments expressed by the Petitioner regarding the addition of 4 votes at polling station Sawai Village 6  of North Seram District for the Relevant Party, so the vote acquisition becomes 50 votes. “According to the Relevant Party, the argument is groundless, because on the subdistrict election supervisory committee (Panwascam) recommendation, the PPK has conducted the recount, including the Petitioner's witness with the counting results in which the Petitioner received 2 votes and the Relevant Party received 50 votes. In this case the Petitioner's witness did not submit any objections or incidents,” said Rikardus.

Errors and Corrections

Elections Supervisory Body (Bawaslu) of Maluku Province through Subair said that based on the supervision results by examining Model C Results of Regency/City DPRD and Copy of Model C Results of DPRD documents at TPS 01 Morokay Village, the PDI-P received 9 votes while the Petitioner obtained 5 votes. On this matter, PPK Seram Timur Kobi found errors in writing numbers and calculations by the polling station working committee (KPPS) when comparing C Results and C Copies.

“At that time, corrections were also made by the PPS witnessed by political parties, PPK, and Panwascam, and the  PDI-P did not sign the minutes of the subdistrict level recapitulation,” said Subair.
