JAKARTA (MKRI) — The General Elections Commission (KPU) as Respondent denied the allegation made by Hanura (People’s Conscience Party), the Petitioner, of unlawful duplicate recapitulation or recount by the Belitang Hulu Subdistrict election committee (PPK) in the Sekadau Regency DPRD election in electoral district 3 in West Kalimantan. The KPU made this clarification at the hearing on the 2024 legislative election results dispute in the Constitutional Court (MK).
“The Petitioner’s claim in their petition that there was illegal double recapitulation or vote recounting by Belitang Hulu PPK, which allegedly resulted in the loss of 128 votes, is not true,” said Agus Riza Hufaida, the Respondent’s legal counsel, in the plenary courtroom on Tuesday May 7, 2024. The case No. 151-01-10-20/PHPU.DPR-DPRD-XXII/2024 was heard by Panel 1, presided over by Chief Justice Suhartoyo with Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
The KPU refuted the alleged double recapitulation that supposedly reduced Hanura’s votes from 1,516 to 1,388 in Sekadau 3, spanning three subdistricts. They reported Hanura received 2,376 votes while PDI-P (Indonesian Democratic Party of Struggle) got 7,203 votes.
The KPU explained that on February 19, 2024, a PDI-P witness objected to the recapitulation results and asked Belitang Hulu PPK to verify data between C-Copy and Sirekap (vote recapitulation information system). The following day, the witness requested a recount at all polling stations (TPS) in the Belitang Hulu Subdistrict.
However, on February 24, the Hanura witness objected to the recount conducted by the district election supervisory committee (Panwascam). The KPU found this ironic, as the recount was meant to resolve earlier objections from witnesses, including the Petitioner’s.

Issue Addressed
Sekadau Regency Bawaslu has addressed a report of alleged administrative election violations during the recapitulation of Hanur’s vote acquisition. It ordered the Sekadau KPU to make administrative corrections and instructed the reported parties not to participate in the 2029 general election and the 2024 local election stages.
The Relevant Party in this case is PDI-P. PDI-P presented a statement fundamentally rejecting the petition.
In the petitum, the Petitioner asks the Court to annul the KPU Decree No. 360 of 2024 on the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide on March 20, 2024, specifically for Electoral District Sekadau 3, Belitang Hulu Subdistrict, Sekadau Regency, West Kalimantan Province. The Petitioner also asks the Court to certify the correct vote results according to the Petitioner for the Sekadau Regency DPRD election in Sekadau 3. According to the Petitioner, Hanura received 2,504 votes.
