KPU: PBB’s Posita and Petitum Asynchronous

JAKARTA (MKRI) — On Tuesday, May 7, 2024, the Constitutional Court (MK) held another DPRD (Regional Legislative Council) election results dispute hearing for case No. 36-01-13-01/PHPU.DPR-DPRD-XXII/2024, filed by the Crescent Star Party (PBB) for Aceh Province. The hearing had been scheduled to hear the response of the General Elections Commission (KPU) as Respondent and testimonies of the Relevant Party and the Elections Supervisory Body (Bawaslu) as well as to validate evidence. It was presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.

Through legal counsel Imam Munandar, the Respondent said that the petition had been filed past the deadline of Tuesday, March 26 at 15:07 WIB and had submitted the revised petition four minutes past the deadline. It also claimed that the petition’s posita and petitum were asynchronous.

“In the posita of the a quo petition, the Petitioner presented comparison between the results in the Petitioner’s and the Respondent’s versions, which then explained that the reason of the vote margin was unlawful purge and mobilization of voters. This shows that the argument is unclear and also unfounded. The fact of the matter is that petitum No. 3 of the petition obviously does not request the Court to determine the correct vote acquisition according to the Petitioner. The Petitioner actually requests a revote. Based on the above explanation, the Petitioner’s petition should be declared inadmissible,” Imam said.

Bawaslu

Bawaslu was represented by members of Aceh Province Panwaslih (voters supervisory committee), Safwani and Fahrul Rizha Yusuf. Bawaslu stated there had been no report nor finding on violations related to the petition’s subject matter in Simeulue Regency. Simeulue Regency Panwaslih had made preventive efforts by issuing appeal No. 040/PM.00.02/K.AC-18/02/2024 dated February 8, 2024 for the Simeulue KIP to carry out voting and vote counting in accordance with applicable procedures.
