JAKARTA (MKRI) — The General Elections Commission (KPU) responses the argument conveyed by the Indonesian Democratic Party of Struggle (PDI-P) regarding the difference in one ballot paper that caused a recount at TPS 006 Simpang Tetap Darul Ikhsan Village on the recommendation of Bawaslu (Elections Supervisory Body) Dumai City. KPU as the Respondent said, there was one voter who returned the presidential and vice presidential election ballot paper to the head of polling station working committee (KPPS).
"The voter told the KPPS chairman that he did not want to exercise his right to vote for the president and vice president and returned the ballot papers, resulting in a difference in the use of special ballots for the election of the president and vice president," said the Respondent’s legal counsel Thomas Mauritius Djawa at the plenary courtroom of Constitutional Court, on Tuesday, May 7, 2024. Case No. 234-01-03-04/PHPU.DPR-DPRD-XXII/2024 was heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzsah in Panel 1.
In addition, there was one voter who had filled in the attendance list at TPS (polling station) 017, but did not exercise his right to vote due to the crowded polling station situation. The voter left the polling station before exercising his right to vote, resulting in one ballot difference.
Then, there are four voters who have submitted C-notification to KPPS and their names have been marked by KPPS. However, the four voters did not sign the C-attendance list so that the KPPS did not add up the four people when counting votes which caused a difference of four users of voting rights.
According to the KPU, there were no witness objections to these incidents during the recapitulation stage at the subdistrict level. There were also no findings or reports of alleged election violations and/or recommendations for revoting (PSU) submitted by TPS supervisors or elections supervisory committee (Panwaslu) of West Dumai Subdistrict.
The KPU said that the correct vote acquisition for the members’ election of Dumai City DPRD Electoral District 4 was PDIP getting 6,864 votes and for members’ election of Rokan Hulu Regency DPRD Electoral District 3 PDIP won 12,168 votes.
The vote acquisition was later confirmed Bawaslu based on the D.results of Regency/City DPRD. According to Bawaslu, PDIP won one seat in the Dumai City DPRD 4.

Apart from the KPU and Bawaslu, the related parties also submitted their responses at today's hearing. The related party for Case No. 234-01-03-04/PHPU.DPR-DPRD-XXII/2024 filed by PDIP is the National Democratic Party (NasDem).
For information, in its petitum, the Petitioner asks the Court to cancel on the certification of the 2024 general election results of the President and Vice President, DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide as well as DPRD members’ election of Dumai City 4 and Rokan Hulu Regency 3. The Petitioner also asks the Court to order the Respondent (KPU) to carry out a revote at the polling stations mentioned above. (*)
