JAKARTA (MKRI) - The General Election Commission (KPU) stated that the implementation of the re-voting (PSU) for the 2024 Election at Polling Station (TPS) 004 in Mekar Utama Village was based on the follow-up of the recommendation from the Ketapang Regency Election Supervisory Agency (Bawaslu). This was conveyed by the KPU (Respondent) in the hearing of the 2024 Election Result Dispute (PHPU) at the Constitutional Court (MK) to respond to the petition filed by a legislative candidate from the Great Movement Party (Gerindra) identified as Sopian Hadi.
The follow-up to this recommendation is the implementation of PSU at TPS 004 in Mekar Utama Village, Kendawangan Sub-district, Ketapang District, which was carried out on February 22, 2024," said the Respondent’s legal counsel Taufik Hidayat in the Plenary Hearing Room 1 Courtroom, Jakarta on Tuesday (5/7/2024). The Case No. 189-02-02-20/PHPU.DPR-DPRD-XXII/2024 hearing was presided over by Panel 1 Justices consisting of Constitutional Chief Justice Suhartoyo, accompanied by Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
According to the KPU, the correct vote acquisition among Gerindra candidates is Sopian Hadi acquired 2,857 votes and Hasim acquired 2,864 votes, while the Gerindra itself acquired 820 votes. The KPU claimed that no addition or reduction of votes or any illegal actions were taken after the vote counting following the re-vote (PSU).
The recapitulation of vote count results after the re-vote, at the district to regency levels, consistently confirmed the vote acquisitions. Additionally, there were no objections from any party or witnesses regarding the vote acquisitions during the recapitulation process after the re-vote, at both the polling station (TPS), sub-district, and regency levels.

Meanwhile, Bawaslu stated that the recommendation for re-vote at TPS 004 in Mekar Utama Village, involving all types of elections, stemmed from information that the Kendawangan PPK (Subdistrict Election Committee) had issued transfer voting forms (Form A5) outside the scheduled stages for additional final voters list (DPTb) totaling 22 individuals who were employees of PT WHW and two individuals from Kubu Raya Regency. Based on the surveillance by Ketapang District Bawaslu, the two voters listed in the DPTb at TPS 004 had changed their residency status from Kendawangan Sub-district, Ketapang District, to Sungai Kakap Sub-district, Kubu Raya Regency. After the re-vote, Bawaslu noted that there were no objections to the vote count results by the witnesses.
As a side note, there were no Relevant Parties in the case filed by the Gerindra's candidate as the Petitioner.
Additionally, in the petitum, the Petitioner requested the Court to annul KPU Decree No. 360 of 2024 on the 2024 Legislative Election Result Stipulation, announced nationally on Wednesday, March 20, 2024, specifically for Dapil Ketapang 6 for the filling of candidates for the Ketapang Regency DPRD in West Kalimantan Province. The Petitioner also requested the Court to stipulate the correct vote acquisition according to the Petitioner for the filling of candidates for the Ketapang Regency DPRD in West Kalimantan Province; and/or at least order the Respondent (KPU) to conduct a Re-voting at TPS 004 in Mekar Utama Village, Kendawangan Sub-district, Dapil Ketapang 6, for the filling of candidates for the Ketapang Regency DPRD.
