JAKARTA (MKRI) — The Crescent Star Party (PBB) has withdrawn its 2024 General Election Results Dispute (PHPU) petition submitted to the Constitutional Court (MK) for the election of council members for the South Halmahera Regency in Electoral District V. This announcement was made by Deputy Chief Justice Saldi Isra during a session that included responses from the respondent (KPU), statements from the Elections Supervisory Agency (Bawaslu), and comments from related parties on Monday, May 6 2024.
"This case (No 127) has been withdrawn," stated Saldi in the Panel Courtroom of Building 2 at the MK, Central Jakarta. The Case No 127-01-13-32/PHPU.DPR-DPRD-XXII/2024 was Presided over by Panel 2–—Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani.
Previously, the petitioner had argued that the recapitulation significantly impacted the allocation of council seats for the South Halmahera Regency's V. According to the petitioner, Irsan Ahmad (PBB) received 1,682 votes, while Irfan Djalil (PAN) obtained 1,639 votes, and Rusdtam Djalil (Democrat) secured 1,698 votes.
The petitioner claimed that the margin vote counts were due to a reduction of 57 votes for the petitioner in South Bacan, East Bacan, and South Mandioli Subdistricts. This reduction was attributed to changes in the Form Plano, Form C Results, Form C Copies, and Form D Results. An additional 181 votes were allegedly given to other council candidates in the three mentioned subdistricts due to assistance from local and regency-level election organizers, including the Regional KPU and Bawaslu.
In their Petitum, the petitioner requested the Court to annul the KPU Decision No. 1098 of 2024 regarding the certification of the General Election results for the Banyumas Regency Council on March 20, 2024, specifically for the election of council members in South Halmahera V. The petitioner also requested the Court to establish the correct vote counts for the petitioner for the election of council members inSouth Halmahera V from the Crescent Star Party (PBB) as follows: Irsan Ahmad 1,682 votes; Irfan Djalil 1,652 votes; and Rusdtam Djalil 1,698 votes.
