KPU Reluctant to Hold Revote for Solok Regency 3 DPRD

JAKARTA (MKRI) — The General Election Commission (KPU) rejected the petitum of the Great Movement Party (Gerindra), which asked the Constitutional Court (MK) to order the implementation of revote for the election of Solok Regency DPRD members in Election District (Dapil) 3 in several polling stations (TPS). According to the Respondent (KPU), the arguments regarding the revote request submitted by the Petitioner do not meet the requirements as stipulated in the Law on General Elections.

"The Respondent rejects the arguments of the Petitioner's petition, which basically asks for a revote for the election for the Solok Regency DPRD at polling stations in Kubung Subdistrict, Solok Regency," said Imamul Muttaqin in the plenary courtroom of Building 1 of the Court, on Monday, May 6, 2024. Case Number 145-01-02-03/PHPU.DPR-DPRD-XXII/2024 was heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah in Panel 1.

KPU explained that the arguments regarding the request submitted by the Petitioner did not meet the requirements stipulated in Article 372 paragraph (2) of the Election Law. KPU claimed that no ballots were removed and no ballots were inserted or transferred to any political party. The correction (renvoi) was carried out with the agreement of witnesses and the subdistrict election supervisory committee (Panwascam). The results of the subdistrict recapitulation plenary meeting were signed by the subdistrict election committee (PPK) and all witnesses present, including witnesses from the Gerindra.

Thus, in its petitum, KPU asked the Court to reject the revote for the election of candidates for the Solok Regency DPRD in a number of polling stations in Kubung Subdistrict, Solok Regency as proposed by the Petitioner.

Meanwhile, the Solok Regency Bawaslu (elections supervisory body) said that the report from the Petitioner on the alleged unsealed ballot boxes did not meet the elements of an election violation as stipulated in Article 538 of the Election Law. However, another report from the Petitioner was declared by West Sumatra Province Bawaslu to be proven as a violation of the election organizer's code of ethics.

For information, in its petitum, the Petitioner asks the Court to cancel KPU Decree No. 360 of 2024 on the certification of the 2024 general election results of the President and Vice President, the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide. He also requested the Court to order the Respondent (KPU) to conduct a revote for the election for the Solok Regency DPRD at TPS 5, 13, 26, 29, 32, 40, 42, 44, 45, 48, 49, and 65 Koto Baru Village; TPS 2, 8, 9, and 46 Salayo Village; TPS 3, 6, 18, and 19 Saok Laweh Village, and TPS 4 Panyakalan Village, Kubung District, Solok Regency.(*)
