KPU Refuses Open the Legislative Election Result in N. Maluku 4

JAKARTA (MKRI) — The General Elections Commission (KPU) refused to open the C. Plenary in several sub-districts spread across North Maluku Province Electoral District (dapil) 4 as requested by the Democratic Party. This is because, according to the KPU (Respondent), there is no court order to open the C Plenary form for the election of the North Maluku Provincial DPRD 4.

"The opening of the C Plenary form must be with Bawaslu's decree based on the C Results form that are questioned at the plenary (meeting) level and must be with an order from the court in the case filed by the Petitioner, that so far there has been no court order to open the C Plano in the Districts of South East Gane, Middle East Gane, East Gane, and Joronga Island," said the Respondent's attorney, Johanes H Martubongs in the Panel Room of Building 2 of the Constitutional Court, Central Jakarta on Monday, May 6, 2024 . Case Number 171-01-14-32/PHPU.DPR-DPRD-XXII/2024 was heard in Panel 2 led by Deputy Chief Justice Saldi Isra (panel chair) and Constitutional Justices Ridwan Mansyur and Arsul Sani.

The KPU stated that during the plenary meeting there were no special events and/or objections from witnesses to the recapitulation of the results of the vote acquisition in the election of the North Maluku Provincial DPRD dapil 4. The request to open C Plenary in several sub-districts is irrelevant because it must be decided by the Elections Supervisory Body (Bawaslu) with a court order.

According to the KPU, the Democratic Party's vote for the election of members of the North Maluku Provincial DPRD dapil 4 is 7,047 votes. Meanwhile, the Perindo Party is 7,059 votes, there is a difference of 15 votes from the Applicant's version.

Meanwhile, Bawaslu stated that the North Maluku Provincial KPU did not follow up on the recommendation of the North Maluku Provincial Bawaslu to conduct research and matching of the D form of the Provincial Sub-District-DPRD Results and the D form of the Provincial District/City-DPRD Results with the C form of the Provincial DPRD Results throughout all polling stations in South Bacan District. The violation until May 2, 2024 was included in the North Maluku Provincial Gakkumdu investigation stage.

The Relevant Party for Case Number 171-01-14-32/PHPU.DPR-DPRD-XXII/2024 filed by the Democratic Party is the Perindo Party. Information from the Perindo Party was also presented in today's hearing.

In its petitum¸ the Petitioner requested that the Court cancel the KPU Decree No. 360 of 2024 on the Stipulation for the 2024 legislative election results of candidates of the DPR, DPD, Provincial and Regency/City DPRD, which announced nationally on Wednesday, March 20, 2024 at 22.19 WIB concerning the vote tally of Perindo in North Maluku 4 for the election of provincial DPRD candidates; Polling Station 1 in Ranga Ranga Village, Gane Timur Selatan Sub-district, South Halmahera Regency, North Maluku Province. The Petitioner also requested to certify the Petitioner version of vote acquisition results of the Provincial DPRD of North Maluku 4. According to the Petitioner, the vote acquisition of Democratic Party was 7,047 votes, meanwhile Perindo acquired 7,044 votes.
