JAKARTA (MKRI) — The Indonesian Democratic Party of Struggle (PDI-P) has filed a petition over the 2024 general election results to the Constitutional Court (MK) for the election House of Representatives (DPR), Provincial Regional Legislative Council/Papuan People’s Representatives Council (DPRD/DPRP), and Regency/City DPRD/Regency/City Legislative Council (DPRK) members in Asmat I electoral district in South Papua Province.
The Petitioner’s legal counsel Paskaria Tombi stated that in Decree No. 21 of 2024 on the certification of the general election results for members of the Asmat Regency DPRD, the Asmat Regency General Elections Commission (KPU) certified that the Petitioner received 8,210 votes, while the National Mandate Party (PAN) received 1,712 votes.
“In our view, there is a vote discrepancy because the Asmat Regency KPU did not follow the proper procedure. They certified the results not by relying on the preliminary meeting correction for subdistrict D.result forms and they refused to correct PAN’s and the Petitioner’s vote acquisition,” stated Tombi in the plenary courtroom on Friday, May 3, 2024. The case No. 271-01-03-35/PHPU.DPR-DPRD-XXII/2024 was heard on Panel 1, presided over by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
Tombi stated that vote inflation occurred during the district-level recapitulation by the district election committee (PPD). The violations included not providing the D-Results documents to witnesses immediately, failing to address the witnesses’ objections, ignoring their reports, not using approved data/documents, and not correcting recapitulation data during the subdistrict preliminary meeting.
In the petitum, the Petitioner asks the Court to annul the KPU Decree No. 360 of 2024 for the Asmat 1 electoral district for the election of members of the Asmat Regency DPRD.
