JAKARTA, MKRI - The National Mandate Party (PAN) filed a petition for the 2024 Election Results (PHPU) of the House of Representatives (DPR) and Regional Legislative Council (DPRD) to the Constitutional Court (MK). In its petition for case No. 57-01-12-25/PHPU.DPR-DPRD-XXII/2024, the Petitioner requested for the annulment of General Elections Commission (KPU) Decree No. 360 of 2024 in North Sumatera Province. The hearing took place at the Court on Friday, May 3, 2024, by justices panel 3, presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.
The petitioner’s legal counsel asserted that the Petitioner alleges the vote acquisition of the Regency DPRD for Minahasa electoral district (dapil) 5 which had been certified by the KPU (Respondent) were incorrect votes. There are allegations that the recapitulation of C Copy results obtained at several polling stations have been added and reduced to win certain political parties.
The alleged fraud by reducing and adding votes for certain political parties affected the position of 5 seats in the Minahasa 5.
"In Minahasa 5, the parties that won seats are the Indonesian Democratic Party of Struggle (PDIP) with 8,475 votes for the first seat, Democrat Party with 5,662 votes for the second seat, the National Democratic Party (Nasdem) with 3,714 votes for the third seat, the Great Movement Party (Gerindra) with 3,617 votes for the fourth seat, then PDIP with 2,825 votes in the fifth seat," said the Petitioner's legal counsel, Rahmat.
The alleged fraud occurred in East Ranotongkor Village, East Tombariri Subdistrict, especially at polling station (TPS) 02 where the number of votes for the Democratic Party based on the C Copy Result of East Ranotongkor Village was 97 votes. However, in the D Result Forms of East Tombariri District it was 102 votes, so there was a difference of 5 votes.
Then, at TPS 4, there was a vote inflation for the PDIP in Ranotongkor village as shown in C Copy Result Forms, where the PDIP votes changed from 38 to 48 votes. This was conducted by subdistrict election committee (PPK) in the subdistrict. At TPS 04, West Lemoh Village, East Tombariri District, the PDIP’s vote inflated by 10 votes, where the additional 10 votes were to win candidate number 1 and the PDIP. This happened because the initial vote acquisition was only 4 votes but then changed to 14. This is known because there was a Tip-x mark on the sheet.
Another alleged fraud occurred in West Lemoh Village, East Tombariri District, at TPS 03 where the PDIP votes increased by 5 votes from a total of 18 to 23 votes. The additional 23 votes are still listed in the D Copy Result Forms. At TPS 06 in Ranowangko Village, Tombariri District, in the Plenary session at the subdistrict level, the PPK made a correction in the numbers, where the PDIP votes increased by 10 votes, namely from 24 to 34 votes, while the National Mandate Party (PAN) went from 0 to 4 votes.
Besides the alleged fraud in the form of additions and reductions which were written in the petition, Rahmat also explained that the alleged fraud also occurred because there were voters who did not have identity in eKTP (electronic identity card). There are 11 voters identified by the Petitioner who cannot exercise their right to vote because they do not have an eKTP.
Ending his presentation, Rahmat read the Petitum Petition, requesting the Court to annul the KPU Decree No. 360 of 2024 on Certification Results of the 2024 President and Vice President, DPR, Regional Representative Council (DPD), Provincial and Regency/City DPRD announced on Wednesday, March 20, 2024, at 22:19 WIB, in Minahasa 5, Minahasa Regency. The Petitioner also requests the Court to instruct the Respondent to carry out Re-Voting at 7 problematic TPS, namely TPS 02 in East Ranotongkor Village; TPS 04 in Ranotongkor Village; TPS 06 in Ranowangko Village; TPS 03 and TPS 04 in West Lemoh Village; TPS 01 in Pinasungkulan Village; and TPS 01 in Poopoh, Minahasa 5.
