No Seat in Papua Pegunungan, Gelora Goes to Court

JAKARTA (MKRI) — The Indonesian People’s Wave Party (Gelora) has filed a petition to the Constitutional Court (MK) on the 2024 DPRD (Regional Legislative Council) election results dispute of Papua Pegunungan Province. The Petitioner claims that his votes were nullified and he failed to win seats in the Tolikara Regency electoral districts 3 and 4, and Central Mamberamo Regency electoral district 3.

“Based on the recapitulation, the Petitioner’s [votes] were nullified. It caused the Petitioner not to obtain a seat,” said the Petitioner’s legal counsel Ratno Timur in the plenary courtroom on Friday, May 3, 2024. The case No. 213-01-07-37/PHPU.DPR-DPRD-XXII/2024 was heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on Panel 1.

Ratno said that Gelora should have obtained 2,224 votes from Bewani District and 895 votes from Bokondini District according to C-result copies. He asserted that the difference in votes was due to a reduction in Gelora's votes at a number of polling stations (TPS) in several subdistricts in Tolikara Subdistrict 3 to for the Tolikara Regency DPRD.

Gelora also obtained 2,481 votes through the noken system from chieftains and community leaders in Bokondini District to be given to legislative candidates from Gelora legislative candidate Dais Baminggen. There were 1,586 votes that had not been included, so according to the Petitioner, Gelora should have obtained 5,600 votes.

The same thing happened in the Tolikara Regency 4 for the DPRD election. According to the Petitioner, Gelora should have obtained 12,924 votes from 26 villages in Nuggawi District and 2,779 votes from Geya District. However, Gelora’s votes were again determined to be zero, whereas they should have been 15,703 votes.

In addition, there was a dispute over 570 votes in the DPRD election for Central Mamberamo Regency electoral district 3. According to the Petitioner, Gelora should have obtained 1,043 votes, not 473 votes as determined by the KPU (General Elections Commission). He stated that there was a transfer of votes from Gelora candidates to PPP candidates.

In its petitum, he requests that the Court annul the KPU Decree No. 360 of 2024 on the certification of the 2024 nationwide legislative election results on March 20, 2024 in relation to the DPRD election of Tolikara 3, Tolikara 4, and Central Mamberamo 3. He also requests the Court to declare the accurate vote acquisition of the Petitioner’s votes as follows: 5,600 votes for Gelora in Tolikara 3; 15,703 votes for Gelora in Tolikara 4; and 1,043 votes for Gelora in Central Memberamo 3.
