JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing on Panel 3 on Friday morning, May 3, 2024, presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih. The case No. 42-02-05-25/PHPU.DPR-DPRD-XXII/2024 was filed by Alfian Bara, candidate number 1 for the 2024 DPRD (Regional Legislative Council) of North Sulawesi Province in electoral district (dapil) 4.
The petitioner has not received a recommendation letter from the Central Executive Board (DPP) of National Democratic Party (NasDem) yet, which is a mandatory requirement for filing a petition. During the hearing, Alfian Bara, who attended via the Zoom application, stated that after comparing the data among D - Bolmong Regency, D - West Passi Sub-district, and D – East Bolaang Sub-district, several issues were identified. Differences were found between the results in Form C1 and D - sub-district and D - Regency. Additionally, on the Form D - results of West Passi Sub-district, Wangga 1 Village, at Polling Station 2, a total of 23 votes were recorded, as follows: Party votes (1), Alfian Bara (0), Nasrun Koto (0), Seska Budiman (12), Tamrin Daun (1), Haslinda (7), Albert Froth (0), Kamran Podomi (2), Suriani Rumoroi (0), Ismail (0), and Rahmat Ali Algaus (0), with a total of 23 valid votes for political parties and candidates. However, there is a discrepancy in Form C1, where Kamran Podomi's votes are recorded as 11, affecting the total valid votes for parties and candidates according to Form C1.
Further irregularities include three polling stations where Form C1 data is not inputted in the official application (Sirekap) of the General Elections Commission (KPU), rendering it inaccessible. These polling stations are Ambang II Village (polling station 3) and Tadoy Village (polling station 5).
In West Passi Sub-district, there is a difference in results between Form C1 and Form D-Result, with 1,236 on Form C1 and 1,233 on Form D-Result for the regency. Therefore, it can be concluded that there is a nominal difference of 3 total votes. In East Bolaang Sub-district, Lolan Village (polling station 1), also found a difference in total party votes. Form C1 records 64 votes for the Indonesian Democratic Party of Struggle (PDI-P) and 77 votes for the Party of Functional Groups (Golkar), while Form D-Result for the regency records 71 for the PDIP and 75 for the Golkar. Hence, it can be concluded that there are irregularities totaling 9 votes.
Furthermore, in East Bolaang Sub-district, Lolan Village (polling station 4), there is a discrepancy between the total votes for parties and candidates overall and the total valid votes cast, with a total of 190 votes for parties and candidates and 198 total valid votes cast. Therefore, it can be concluded that the difference between the total votes for parties and candidates overall and the total valid votes cast is 8 votes.
Last, in East Bolaang Sub-district, Tadoy Village, there is a margin in vote count between Form C1 and Form D-Result for the regency, where the total number of PDIP votes in the Regency D-Result is 98 votes, while based on the C1 form compiled by witnesses, it totals 96 votes. Therefore, it can be concluded that there is an increase of 2 votes in the PDIP.
"We request that the Court cancel the KPU Decree No. 360 of 2024 on the certification of election results for the President and Vice President, House of Representatives (DPR), Regional Representatives Council (DPD), Provincial and Regency/City DPRD nationally in the 2024 General Elections, announced on Tuesday, March 20, 2024, at 21:30 WIB. Additionally, we request that the Court disqualify Pairs Number 5 and 7 from the NasDem as Candidate for the Provincial DPD in the 2024 Election," concluded Alvian Barra.
