JAKARTA (MKRI) — Vote acquisition for the People's Conscience Party (Hanura) were allegedly transferred to the Indonesian Solidarity Party (PSI) in the sub districts of Warmare, South Manokwari, and Tanah Rubuh, amounting to a total of 200 votes. This claim was presented by Syaefullah Hamid, legal counsel for Hanura (Petitioner), during the Preliminary Hearing of the 2024 Election Results Dispute for Members of the House of Representatives (DPR), Provincial Legislative Councils (DPRD Province), and Regency/City Legislative Councils (DPRD Regency) at the Constitutional Court (MK). The session for Case No 69-01-10-34/PHPU.DPR-DPRD-XXII/2024 was held on Friday, May 3, 2024.
Before Panel Hearing 2, presided over by Deputy Chief Justice Saldi Isra with Constitutional Justices Ridwan Mansyur and Arsul Sani, the Petitioner requested the Court to annul the General Elections Commission (KPU) Decision No. 360 of 2024 concerning the Certification of Election Results for the President and Vice President, DPR, DPRD Provincial, DPRD Regency nationwide, which was announced on Wednesday, March 20, 2024.
Syaefullah outlined the vote tallies for both parties in the three subdistricts, stating that according to the Respondent, Hanura received 1,477 votes, while the Petitioner claims it was 1,677 votes. In contrast, PSI received 654 votes according to the Respondent and 454 votes according to the Petitioner, leading to a discrepancy of 200 votes.He emphasized an incident at polling station 01 of Umnum Village in Rubuh Subdistrict where a PSI candidate named Masimus Suga acknowledged manipulating votes and subsequently expressed a desire to retract them. The Petitioner argues that this transfer of 200 votes from Hanura to PSI is unjustifiable, as it contravenes Article 48, paragraph (6), letter f of KPU Regulation No. 5 of 2024.
"Based on these arguments, the Petitioner requests that the Court detemine the correct vote tally according to the Petitioner for filling the membership of the DPRD Regency in Manokwari 3, where Hanura should have 1,677 votes and PSI 454 votes. The Petitioner also orders the KPU to implement this decision," stated Syaefullah.
