Gerindra Candidate Requests Revote in South Minahasa 3

JAKARTA, MKRI – The Great Movement Party (Gerindra) filed a petition over the 2024 DPR/DPRD (House of Representatives/Regional Legislative Council) election results for the electoral district South Minahasa 3 of North Sulawesi to the Constitutional Court (MK). A preliminary hearing for the case No. 31-01-02-25/PHPU.DPR-DPRD-XXII/2024 took place at Panel 3 of the Court on Friday, May 3, 2024 at 09.03 WIB, presided over by the Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.

Through its legal counsel Herfino Indra, the Petitioner requests for the annulment over General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the 2024 election results of the President and Vice President, DPR, DPD (Regional Representatives Council), and Provincial and Regency/City DPRD announced nationwide on March 20, 2024 at 22:19 WIB. The Petitioner filed the petition due to an election violation that was disadvantageous to the results of the Petitioner's votes, especially in South Minahasa 3. According to the Petitioner, the vote margin occurred in Pinaesaan, Sion, Raraatean, Karowa, Tompaso Baru I, and Torout Villages of Tompaso Baru Subdistrict.

“There is evidence of recorded conversations between the person in charge, village heads, village officials, and the Indonesian Democratic Party of Struggle (PDI-P) council members on behalf of Jonly Ombeng, under the direction of the person in charge of the South Minahasa Regency DPRD’s Chairman, namely Stevem Lumowa to win the PDI-P by all means. Including taking votes from the Gerindra as evidenced by the audio recording,” Herfino said.

There was a directive to distribute money envelopes of Rp150,000 to Tambelang Village’s people and direct them to vote for candidate numbers 5 and 1 from PDI-P. Fraud also occurred at polling station (TPS) 004 where the voter attendance list data in the final voters list (DPT) who exercised their voting rights were different from data owned by Gerindra witnesses. All of these alleged frauds have been reported as alleged election administration violations to the Election Supervisory Body (Bawaslu ) of South Minahasa Regency.

In its Petitum, the Petitioner requests the Court to annul KPU Decree No. 360 in the a quo case and order the Respondent to conduct a revote in South Minahasa 3.
