JAKARTA, MKRI - The Constitutional Court (MK) held a preliminary hearing on the Dispute over the Results of the General Election of Members of the House of Representatives (DPR) and the Regional Legislative Council (DPRD) (PHPU DPR) in 2024 submitted by Harley Alfredo Benfica Mangindaan, a candidate for North Sulawesi Provincial DPRD Election District (Dapil) 1 from the Democratic Party. The Case No. 81-02-14-25/PHPU.DPR-DPRD-XXII/2024 was held on Friday (03/05/2024) at 08.50 WIB, by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.
The Petitioner Harley Alfredo Benfica Mangindaan filed to the Court regarding the Dispute over General Election Results (PHPU) for members of the House of Representatives, Provincial DPRD, Regency / City DPRD in North Sulawesi Province Election District 1 related to the general Elections Commission (KPU) Decree No. 360 of 2024 concerning the Determination of the General Election Results of the President and Vice President, Members of the House of Representatives, Regional House of Representatives, Provincial Regional House of Representatives, and Regency / City Regional House of Representatives which were Announced Nationally in the Election on Wednesday, March 20, 2024 at 22:19 WIB.
Cepi Hendrayani as Petitioner's legal counsel explained that the Petitioner alleged fraud in the vote counting process by adding the votes of Democratic Party candidate no. 1 on behalf of Royke Reynald Anter. The alleged fraud occurred at polling station 03 Dendengan Dalam Village, Paal 2 District, Manado City. The difference of votes due to the addition was 1 vote increase for Royke Reynald. The fraud at polling station 03 occurred because according to the C-Result data owned by the Petitioner, 8 votes should have belonged to candidate no 1. This result is different from the D-Result data owned by the Respondent, which is 9 votes. There was an excess of 1 vote in favor of Royke Reynald Anter. The Petitioner argued that the excess of 1 vote is invalid due to a writing error.
In addition to the alleged fraud at polling station 03, there were also additional votes cast by the Respondent for Royke Reynald at polling station 02, Manado Tua Village. Vote count results were different due to the addition of 6 ballots which increased to Royke Reynald. According to the Petitioner's data (C-Results), Royke Reynald should have received 54 votes, but according to the Respondent's data (D-Results), he received 60 votes, indicating an additional 6 votes for Royke Reynald. These discrepancies favor the Democratic Party candidate, Royke Reynald Anter.
After that, allegations of fraud also occurred at polling station 06 Paniki Bawah Village, Mapanget Subdistrict, Manado City where 1 vote was added to Royke Reynald. The addition at polling station 06 was because according to the C-Result data owned by the Petitioner, there should have been 5 votes belonging to Royke Reynald. However, in the Respondent's D-Results there were 6 votes. There was an excess of 1 vote in favor of Royke Reynald.
Other allegations of fraud related to the addition of votes for other candidates also occurred at TPS 013 Bailang Village, Bunaken District, Manado City where the total difference from the polling station was 2 votes for the superiority of candidate number 1 Royke Reynald. Then at TPS 02 Bunaken Village, Bunaken Subdistrict, Manado City Islands where the total difference from the polling station was 3 votes. Alleged fraud at TPS 20 Malalayang Satu Timur Village, Malalayang District, Manado City where the total difference from the TPS was 10 votes increased to Royke Reynald. Then fraud at polling station 17 Pakowa Village, Wanea Subdistrict, Manado City, where the total difference from the polling station was 1 vote and other alleged additional votes that have occurred at several polling stations for the benefit of Candidate Number 1 Royke Reynald.
"Because, the Petitioner requests the Court to cancel the KPU Decree No. 360 of 2024 concerning the Determination of the General Election Results of the President and Vice President, Members of the House of Representatives, Regional House of Representatives, Provincial Regional House of Representatives, and Regency / City Regional House of Representatives which were Announced Nationally in the Election on Wednesday, March 20, 2024 at 22:19 throughout the aquo Election District (Dapil)," said Cepi Hendrayani.
In addition to the annulment, the Petitioner also asked the Court to confirm the accurate vote counts according to the Petitioner. Specifically, for the Democratic Party candidates in North Sulawesi Province's DPRD District one, Royke Reynald Anter received 18,940 votes, and Harley Alfredo Benfica Mangindaan received 18,963 votes.
