JAKARTA (MKRI) - The Democratic Party has filed a petition on the 2024 Election Results Dispute (PHPU) to the Constitutional Court (MK) on the appointment of Members of the Regional Representative Council (DPRD) for District 1 in Kotamobagu City, North Sulawesi Province. The preliminary hearing for Case No. 15-01-14-25/PHPU.DPR-DPRD-XXII/2024 was filed by the Democratic Party. The hearing was held in Panel 3 Courtroom on Friday (03/05/2024). It was presided over by Chief Justice Arief Hidayat, accompanied by Constitutional Justice Anwar Usman and Constitutional Justice Enny Nurbaningsih.
"According to the Respondent, the National Democratic Party (NasDem) acquired 1322 votes, whereas the Democratic Party acquired 1295 votes. This leads to a discrepancy of 27 votes, resulting in NasDem securing the final seat. However, according to the Petitioner, the NasDem acquired 1277 votes, whereas the Democratic Party acquired 1358 votes, indicating a vote margin of 81 votes," said Petitioner's legal counsel Yandri Sudarsono.
The Petitioner alleges that the discrepancy in votes is attributed to suspected violations of vote inflation at the subdistrict election committee (PPK) level in Kotamobagu Utara Sub-district. During the Plenary Meeting of the Kotamobagu Utara Sub-district's vote tally from Saturday, February 17, 2024, to Saturday, February 29, 2024, numerous violation incidents were uncovered, particularly at polling stations (TPS) 4 Pontodon, TPS 6 Pontodon, TPS 2 Genggulang, and TPS 1 Bilalang Satu.
"We have expressed objections to the vote count results; however, the response received was extremely disappointing, as it led to the expulsion of any witnesses who disagreed with the tallying results," stated Yandri.
Further irregularities include the disappearance of ballot boxes and their contents from the plenary meeting room, where all ballot boxes had been moved or gone missing and their whereabouts were unknown from 8:00 AM WITA to 9:00 AM WITA on February 29, 2024, while the plenary meeting for the vote tally was only concluded on March 1, 2024, around 02:00 AM WITA.
