JAKARTA, (MKRI) —The Democratic Party has filed a petition over the 2024 general election results to the Constitutional Court (MK) for the election of DPRD (Regional Legislative Council) members in the electoral districts of Papua Pegunungan 2 in Papua Pegunungan Province, on Friday May 5,2024, in the MK Preliminary Court Room. Case No. 146-02-14-37/PHPU.DPR-DPRD-XXII/2024  was filed by Efraim Jendrik A Wandik from the Democratic Party.

Hendrik Tomasoa, the petitioner's legal counsel, said during the hearing that the petitioner is candidate for the Provincial DPRD of Papua Pegunungan, representing the Papua Pegunungan 2 electoral district, Lanny Jaya Regency, Mountainous Papua Province.

“According to the Decree of the Papua Pegunungan Provincial General Elections Commission (KPUD) NO. 6 of 2024 On the Certification of the General Election Results for Members of the Provincial Legislative Council of Mountainous Papua 2024, the petitioner received 1,485 valid votes, ranking second”. He said before the Panel of Justices headed by Chief Justice Suhartoyo.

The petitioner claimed the loss of 34,511 votes for the mentioned difference in vote acquisition. The chairpersons and members of the District Election Committees (PPD) in nine districts—Privime, Wiringgambut, Nogi, Malagineri, Wano Barat, Milimbo, Tigime, Dimba, and Gelokbeam—transferred the petitioner's votes to Onies Wenda, a legislative candidate from another party, in Wiringgambut

The petitioner claimed that the Lanny Jaya Regency KPU recapitulation and the Recapitulation of Valid Vote Count Results by PPD chairpersons and members on the nine districts are inaccurate. The Mountainous Papua Provincial KPU approved the results despite the evidence. Because of this The Petitioner received 1,485 votes, missing 20,933 votes.

In the petitum, The petitioner asked the Court to annul the General Elections Commission Decree No. 360 of 2024 for Papua Pegunungan 2 from the Democratic Party, Ballot Number 2, in his name and asked the court to certify the correct result of the votes cast for him. The petitioner asked the court to certify that he received 35,996 votes from the Democratic Party on Ballot Number 2 to fill the positions of Provincial DPRD members in Papua Pegunungan 2.
