Votes Reduced in Samosir 1, Perindo Goes to Court

JAKARTA (MKRI) — A Preliminary Hearing on the legislative election results dispute (PHPU) of Regional Legislative Council (DPRD) Samosir Regency 1 was held at the Constitutional Court (MK) on Thursday (5/2/2024). Case No. 149-01-16-02/PHPU.DPR-DPRD-XXII/2024 was filed by the United Indonesia Party (Perindo). 

In the hearing that was heard by Chief Justice Suhartoyo, Radius Emerson Sitanggang as the Petitioner said that his votes were right and affected the Samosir Regency Regional Legislative Council (DPRD) election in the Electoral District (Dapil) Samosir I, there was a difference of Perindo by 38 votes which affected the determination of seats for Samosir Regency DPRD in the electoral district Samosir I.

“The difference in votes was caused by a reduction in the vote acquisition of the Petitioner in the recapitulation of votes at polling station (TPS) 12 in Pardomuan I Village,” explained Radius in the Plenary Session Room of the Court.

Sitanggang argues that the reduction was due to the unauthorized crossing out of the Petitioner’s votes on C-results form. Then he also explained, another fact found that until the day before the recapitulation process at the subdistrict election committee (PPK) level in Pangururan Subdistrict was carried out, all Model C-results forms for Regency/City DPRD at each polling station in Samosir 1 had been uploaded by the Respondent (KPU) on the vote recapitulation information system (Sirekap) page, except for Model C-results forms for Regency/City DPRD at TPS 12, Pardomuan I Village, Pangururan Subdistrict. This is one of the proofs that the implementation of voting and vote counting at TPS was not in accordance with KPU Regulation No. 25 of 2023. Therefore, the vote acquisition of the Perindo at TPS 12 of Pardomuan I Village according to the Respondent cannot be believed in its validity and legitimacy.

In his petition, the Petitioner requests to the Court cancel the KPU Decree Number 360 of 2024 as long as it concerns the vote acquisition of candidates for Samosir Regency DPRD Samosir 1 in TPS 12 Pardomuan I Village, Pangururan District, Samosir Regency. He also requests the Court to determine regarding the vote acquisition of Samosir Regency DPRD Candidates in Samosir District 1 TPS 12 Pardomuan I Village, Pangururan District, Samosir Regency for the Perindo amounting to 1,569 votes.
