JAKARTA (MKRI) — Constitutional Court held a preliminary hearing for PHPU of the House of Representatives (DPR), Provincial Regional Legislative Council (DPRD), Regency/City DPRD in 2024 (PHPU DPR/DPRD) against the petition of the United Development Party on Thursday (2/5/2024). The hearing Case No. 93-01-17-19/PHPU.DPR-DPRD-XXII/2024 was carried out by panel 2 presided by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani from Panel Hearing Room, the second building of the Constitutional Court, Jakarta.
Petitioner’s legal counsel Andra Bani Sagalane said that based on the PHPU Decree No. 360 of 2024 on the Certification of the 2024 Legislative Election Results of the President and Vice President, DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide on March 20, 2024 at 22:19 WIB throughout the results of the general election of DPR in 2024 in Dapil NTT I and NTT II, did not fulfill the 4% parliamentary threshold requirement.
In NTT I, according to the Respondent, the United Development Party (PPP) received 18,497 votes and the Garuda Party 7,524 votes. Petitioner believes that PPP received 25,697 votes and Garuda only 324 votes, resulting in a difference of 7,200 votes between the parties. Meanwhile, in the NTT II, according to the Respondent, the PPP received 36,169 votes and the Garuda Party 11,577 votes. Petitioner believes that PPP received 47,620 votes and Garuda only 126 votes, so between the parties there was a difference of 11,451 votes. Andra said, “The transfer of votes occurred as a result of a counting error by the Respondent”.
“Based on the explanation above, the Petitioner requests the Court to hand down a decision to stipulate that the results of the vote acquisition of the Petitioner and the Garuda Party are valid for the NTT I , the PPP received 25,697 votes, while the Garuda Party received 324 votes. For the NTT II, the PPP received 47,620 votes and the Garuda Party received 126 votes,” Andra told the Panel.
