JAKARTA (MKRI) — The Nusantara Awakening Party (PKN) filed petition on the 2024 Legislative Election Results Dispute (PHPU) to the Constitutional Court (MK) for the membership of the Provincial Legislative Council (DPRD) of Papua in Electoral District (Dapil) 6 and the Regency Legislative Council (DPRD Regency) of Yapen Islands in Electoral District 1. The Petitioner alleges a reduction in PKN's votes and an increase in votes for other political parties.

"According to the Petitioner, the vote margin is due to reductions and additions in the votes of all political parties during the recapitulation at the South Yapen Subdistrict level," stated the Petitioner's legal counsel, Darwin Panggabean, in the Panel Hearing Room of Building 2 at the Court, Central Jakarta, on Thursday, May 2, 2024. The Petitioner mentioned that PKN witnesses were not provided with a copy of Form C1.

The Petitioner reports a reduction of 1,643 votes for PKN during the recapitulation in South Yapen Subdistrict. The Petitioner claims to have received 3,474 votes, but the General Elections Commission (KPU) determined that PKN received 776 votes.

Meanwhile, there was an increase of 1,643 votes for the Perindo Party. The Petitioner contends that the United Indonesia Party (Perindo) should have received 1,254 votes instead of the 2,897 votes as determined by the KPU.

Therefore, in their petitum, the Petitioner requests that the Court annul the KPU Decision No. 360 of 2024 concerning the Certification of  2024 Election Results for Members of the House of Representatives, the Regional Representatives Council, Provincial Legislative Councils, and Regency/City Legislative Councils nationwide, announced on Wednesday, March 20, 2024, at 22:19 WIB, specifically for Papua 6 for the election of members of the Provincial Legislative Council of Papua and Yapen Islands 1 for the election of members of the Yapen Islands Regency Legislative Council. The Petitioner also requests the Court to establish the correct vote tally according to the Petitioner for filling the membership of the Provincial Legislative Council of Papua 6: PKN 3,474 votes and for the membership of the Yapen Islands Regency Legislative Council in Electoral District 1, particularly South Yapen Subdistrict: PKN 916 votes.

The hearing for case No 167-01-09-33/PHPU.DPR-DPRD-XXII/2024 on Panel 2, presided over by Deputy Chief Justice Saldi Isra, accompanied by Constitutional Justices Ridwan Mansyur and Arsul Sani.
