PKB Candidate Asks KPU Decree Reviewed, Alleges Vote Shift

JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing for the election results disputes (PHPU) of the Regional Representatives Council (DPD) and Regional Legislative Council (DPRD), Thursday afternoon, May 2, 2024. The hearing was presided over by Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih, in panel 3.

The case No. 232-02-01-06/PHPU.DPR-DPRD-XXII/2024 filed by Soderi Tario, a Regional Legislative Council (DPRD) candidate Number 1 of Ogan Komering Ulu Regency, electoral district (Dapil) 2, from the National Awakening Party (PKB). The object of the dispute is the General Election Commission (KPU) Decree Number 360 of 2024.

The Petitioner argued that there was a difference in the vote count between the Respondent and the Petitioner, particularly in relation to the votes obtained by him and PKB candidate number 9, on behalf of Muslimin. He argued that the votes obtained by the Muslimin should be 2,204 votes, different from the 2,333 votes certified by the KPU (Respondent). The Petitioner also noted that the PKB votes should be 868 votes, different from the 839 votes certified by the Respondent.

"According to the Respondent, the National Awakening Party obtained 839 votes. According to the Petitioner, 868 votes. This means there is a reduction of 29 votes, Your Honors," said legal counsel Raden Adidarmo Pramudji.

The Petitioner stated that the margin of votes was caused by the reduction of 29 votes from the PKB and the addition to Muslimin, at 18 polling stations in Ulu Ogan Sub-district. This allegedly occurred because of data input errors by the Respondent, which were documented in the C1 TPS and D-Results Sub-district documents. According to the Petitioner, this vote shift resulted in the Petitioner's vote lower than Muslimin's vote. However, if the shifted votes were returned, the Petitioner would be 6 votes higher than Muslimin.

"There are Party votes that are included in candidate number 9 on behalf of Muslimin. If the votes are not transferred, then the Petitioner is higher with 2,210 votes," said Raden Adidarmo.

For this reason, the Petitioner requests that the Court grant his petition by canceling the KPU Decree No. 360 of 2024 and certify his version of the vote acquisition results.
