JAKARTA (MKRI) — The Indonesian Democratic Party of Struggle (PDI-P) filed a 2024 Legislative Election Results Disputes (PHPU) petition to the Constitutional Court for the election of candidates for DPRD Electoral District (Dapil) 2 of Sarmi Regency, DPRD Dapil 1 of Jayapura Regency and Dapil 3 Jayapura Regency. The PDI-P (Petitioner) expressed a sense of disadvantage due to a decrease in their votes, which led to the acquisition of legislative seats in the area.

The Petitioner felt disadvantaged by the recommendation of the Elections Supervisory Body (Bawaslu) to calculate by eliminating PDI-P’s votes by 127 votes, which was conducted in a non-transparent manner and contrary to the principles of elections for the filling of candidates for DPRD Dapil 2 of Sarmi Regency. 'The incident occurred in Apauwer Hulu District,' said the Petitioner's legal counsel, Heri Perdana Tarigan, in the Panel Room of the Second Building of the Constitutional Court, Central Jakarta on Thursday (2/5/2024).

According to the Petitioner, there was a vote switch between the Nusantara Awakening Party (PKN) and PDI-P votes, allegedly carried out by elements of the Sentani District Election Committee for the filling of Dapil 1 DPRD of Jayapura Regency. Furthermore, the Petitioner mentioned that PDIP could potentially secure one seat as a member of the Dapil 3 DPRD Jayapura Regency if there were no reduction of 260 votes in Waibu District. The increase in votes actually occurred for the Golkar Party, National Democratic Party (NasDem), Indonesian People’s Wave Party (Gelora), Prosperous Justice Party (PKS), and PKN.

In his petitum, the Petitioner requests the Court to cancel the General Election Commission Decree No. 360 of 2024 on Stipulation of PHPU for Members of the DPR, DPD, Provincial DPRD, and Regency / City DPRD nationally in the 2024 Election which announced nationally on Wednesday, March 20, 2024 along Dapil 2 for filling candidates for members DPRD of the Sarmi Regency and Dapil 1 and Dapil 3 for filling candidates for members DPRD of the Jayapura Regency. The Petitioner also requests the Court to stipulate the correct vote acquisition results according to the Petitioner as follows: Dapil 2 DPRD of Sarmi District: PDIP 584 votes and Nasdem 973 votes; Dapil 1 DPRD of Jayapura District: PDIP 1,296 votes and PKN 1,256 votes; and Dapil 3 DPRD of Jayapura District: PDIP 1,914 votes, Golkar 1,702 votes, and Nasdem 2,209 votes.

The hearing for  case No. 140-01-03-33/PHPU.DPR-DPRD-XXII/2024 was presided over by Deputy Chief Justice Saldi Isra (chair panel) with Constitutional Justices Ridwan Mansyur and Arsul Sani.
