JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing on the Election Results Dispute (PHPU) of the House of Representatives (DPR) and Regional Representatives Council (DPRD) on Thursday afternoon (5/2/2024). The hearing was presided over by the Constitutional Justices Arief Hidayat, Anwar Usman, and Enny Nurbaningsih. 

The hearing was held in Panel 3 Courtroom, examining Case No. 111-01-13-24/PHPU.DPR-DPRD-XXII/2024. This case was filed by the Crescent Star Party (PBB), represented by Yusril Ihza Mahendra as the Chairman and Afriansyah Noor as the Secretary General, regarding the filling of Bulungan DPRD members in North Kalimantan Province's Electoral District (Dapil) Bulungan 1. The subject of this petition is General Election Commission (KPU) Decree No. 360 of 2024.

At the hearing, the Petitioner alleged that there was vote inflation  for the Functional Groups Party (Golkar) in three polling stations (TPS), namely TPS 039, TPS 060, and TPS 076 in Tanjung Selor Hilir Village, Tanjung Selor Sub-district. Meanwhile, the addition of votes for the Golkar in three TPS resulted in a reduction of the Petitioner's votes in one TPS, namely in TPS 039 of Tanjung Hilir Village, by 3 votes. "In Bulungan 1 Electoral District, there has been an increase in votes favoring the Golkar at three TPS, namely TPS 039, TPS 060, and TPS 076 in Tanjung Selor Sub-district," said the Petitioner's legal counsel Langen Subha Pangestu.

According to the Petitioner's petition, the correct vote for Golkar was 5,816 votes, different from the previous count stipulated by the Respondent (KPU) of 5,820 votes. Meanwhile, according to the Petitioner, the correct vote for the Petitioner is 1,943 votes, different from the count stipulated by the Respondent of 1,940 votes.

“Menurut Pemohon Golkar 5.816 Termohon 5820, terdapat penambahan 4 suara. PBB menurut Temohon 1.940, menurut Pemohon 1943, terdapat pengurangan 3 suara Majelis,” ungkap Langen Subha Pangestu. 

"According to the Petitioner, Golkar acquired 5,816 votes, while the Respondent recorded 5,820 votes, indicating an increase of 4 votes. whilst the Respondent said that the PBB was recorded as having acquired 1,940 votes, yet the Petitioner declared that it was supposed to be 1,943 votes, indicating a reduction of 3 votes," explained Langen Subha Pangestu.

The Petitioner explained that the Respondent's error in adding votes for the Golkar has affected the Petitioner's acquisition of seats, particularly for the last seat, or the 9th out of a total of 9 seat quotas for the Dapil Bulungan 1.

In their petition, the Petitioner requested the Court to grant their petition to revoke KPU Decree No. 360 of 2024 and stipulate the correct vote count according to the Petitioner for Dapil Bulungan 1’s DPRD in the Bulungan Regency.
