JAKARTA, MKRI – the National Democratic Party (NasDem) filed a petition to the Court to dispute the 2024 General Election Results (PHPU) for the filling of candidates for the House of Representatives (DPR) members in South Sumatra Province, South Sumatra Electoral District I and South Sumatra Electoral District II, Lahat Regency DPRD 4. The preliminary examination session of NasDem's case, Case Number 275-01-05-06/PHPU.DPR-DPRD-XXII/2024, was held at the court on Thursday (02/05/2024) presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.
The NasDem Party (Petitioner) through its legal counsel, Dhabi Kusumanegara Gumayra filed a petition to annul the General Election Commission Decision Number 360 of 2024. Dhabi revealed that the Democratic Party's total votes should have amounted to 141,555, while the Petitioner's total votes were 142,498. Therefore, the Petitioner should be entitled to the eighth seat of the DPR in the electoral district of South Sumatra 1.
"There was an addition of 2301 votes to the Democratic Party, therefore the Petitioner lost the opportunity to get the 8th seat of the DPR in the South Sumatra I Constituency," said Dhabi.
The vote inflation for the benefit of the Democratic Party allegedly occurred during the recapitulation of the vote count at Banyuasin I PPK, Banyuasin III PPK and Muara Telang in Banyuasin Regency PPK, South Sumatra Province. As a result of the fraud, the Petitioner lost the opportunity to obtain the 8th seat of the House of Representatives in South Sumatera I electoral district.
In addition, allegations of fraud also occurred in the electoral district of South Sumatra II where the Prosperous Justice Party (PKS) should only have received 134,066 votes, then changed to 135,729 votes. Furthermore, there were allegations of fraud found in the acquisition of seats for Lahat Regency DPRD members in the Lahat 4 electoral district that occurred at polling stations 1 and 2 in Tanjung Kurung Ulu, and polling station 2 Tanjung Menang.
In the Petitum, the Petitioner requested the Court to cancel KPU Decision Number 360 of 2024 related to the a quo case. Then ask the Court to determine the correct vote acquisition results for the petitioner.
