JAKARTA (MKRI) — The National Democratic Party (NasDem) filed a petition on the 2024 DPR (House of Representatives) results dispute election of Bangka Belitung Islands Province to the Constitutional Court (MK). NasDem has a difference of 35,077 votes with the Party of Functional Groups (Golkar) in the legislative election in the electoral district Bangka Belitung Islands Province.
The Petitioner believes the process of counting ballots at the polling stations (TPS) by the polling station working committees (KPPS) had many significant errors, resulting in NasDem’s ballots becoming invalid at 2,186 polling stations based on data from the subdistrict and regency DPR D-result forms. As a result, NasDem lost 41,909 votes.
“Nasdem’s recapitulation witness at the central level has objected to the DPR election invalid votes, which were very high, and proposed a recount at all polling stations in Bangka Belitung Islands Province,” said legal counsel Armansyah in the plenary courtroom on Thursday, May 2, 2024.
The Petitioner believes NasDem’s total votes should have amounted to 122,381 votes and it should have been in third place. However, the KPU determined that NasDem only received 80,472 votes and ranked fourth while Golkar ranked third with 115,549 votes. Thus, NasDem did not get a seat because there were only three seats available for the electoral district of Bangka Belitung Islands.
In its petitum, the Petitioner requests the Court to cancel the General Elections Commission (KPU) Decree No. 360 of 2024 concerning the vote acquisition in the DPR election of Bangka Belitung Islands Province. It also requests the Court to order the KPU to conduct a recount in Bangka Belitung Islands Province in 2,186 polling stations in 368 villages, 47 subdistricts, and 7 regencies/cities by including political party witnesses.
The Case No. 282-01-05-09/PHPU.DPR-DPRD-XXII/2024 was heard by Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic and M. Guntur Hamzah in Panel 1.
