JAKARTA (MKRI) — Mohamad Arif Rizky Budiman, candidate number three for the Provincial Legislative Council (DPRD) from the Great Movement Party (Gerindra), has filed a petition on the 2024 Legislative Election Results Dispute (PHPU) for Members of the House of Representatives (DPR RI), Provincial Legislative Councils (DPRD Province) , and Regency/City Legislative Councils (DPRD Regency). At the Preliminary Hearing for Case No 254-02-02-18/PHPU.DPR-DPRD-XXII/2024, Samuel Partogi Apriliano, legal counsel for the Petitioner, presented the main points of the petition in the Panel Hearing Room, Building 2 of the Constitutional Court on Thursday, May 2, 2024.
Before Panel 2 of the Court, presided over by Deputy Chief Justice Saldi Isra with Constitutional Justices Ridwan Mansyur and Arsul Sani, Samuel stated that the Petitioner is requesting the Court to annul the General Elections Commission (KPU) Decision No. 360 of 2024 concerning the Certification of Election Results for the President and Vice President, Members of DPR RI, the Regional Representatives Council (DPD), DPRD Province, and DPRD Regency/City nationwide, announced on Wednesday, March 20, 2024, specifically for West Nusa Tenggara 4.
The Petitioner alleges that there was fraud and/or transfer of votes from the Petitioner to Syamsu Rijal, candidate number one from Gerindra, and Desy Susanti, candidate number six from Gerindra,, totaling 574 votes from 17 polling stations. According to the Petitioner, this data comes from three subdistricts: East Sakra, Terara, and Jerowaru. Moreover, the Petitioner alleges that vote transfers occurred in five other subdistricts. Consequently, they are requesting a recount to verify the suspected vote transfers at 1,535 polling stations in West Nusa Tenggara 4.
“Instruct the General Election Commission (KPU) to conduct a vote recount in West Nusa Tenggara 4 to validate the alleged vote transfers”, stated Samuel.
