Democratic Party's Efforts to Secure the Last Seat in Papua

JAKARTA (MKRI) — The Democratic Party submitted petition on the 2024 Legislative Election Results Dispute (PHPU Legislative) to the Constitutional Court (MK) to fill in candidates for members of the House of Representatives (DPR), and DPRD in Papua Province. The Democrats argued that there were margin in votes in Electoral District (Dapil) 1 and 5 of the Papua Province DPRD; Dapil 1 and 4 Yapen Islands; as well as Dapil 3 DPRD Jayapura City.

According to the Democratic Party (Petitioner), its vote was declared to have received 7,551 votes in Dapil 1 of Papua Province to fill membership in the Papua DPRD (DPRP). Meanwhile, the vote acquisition for the Golkar Party, which won two seats on the recapitulation of the plenary results, was 22,987 votes, as per the D-Form Results. This difference caused the Democrats not to get the eighth seat.

"This is contesting the last seat, Your Honor" said the Petitioner's legal counsel, Muhajir in the Panel Courtroom on Thursday (2/5/2024).

However, the Petitioner argued that the results for Golkar (the Party of Functional Group) did not align with the facts at the polling stations (TPS). They claimed that there were inflated votes starting from the district level by the KPU of Abepura District, Jayapura City, and Papua Province. The Petitioner further contended that Abepura District deliberately inflated the votes evenly across all parties to obscure the intention of securing two seats for Golkar.

The Petitioner filed a petitum based on disputes in five electoral districts  mentioned. Submitting a petitum as follows: The Petitioner requests the Court to annul General Election Commission Decision No. 360 of 2024 on the 2024 Stipulation of the election for Members of the DPR, DPD, and DPRD which was announced nationally on March 20, 2024 at 22.19 WIB as long as:

  • The vote count for Golkar Party is as follows: the plenary results from the Abepura District reflect the combined votes of the Democratic Party and Golkar Party in Dapil 1 Papua Province, returning the vote count from the TPS.

  • The vote count for PDIP (the Indonesian Democratic Party of Struggle) and Golkar Party in the Roufaer and Mamberamo Hulu Districts is also being returned, including 1,079 votes from the petitioner in both districts.

  • The vote count for the Golkar Party, PKN (the Nusantara Awakening Party) and Perindo (the United Indonesia Party), in the 1st Dapil of the Yapen Islands Regency in Papua Province's DPRD member allocation, establishing the correct vote count according to the petitioner for the Democratic Party for 1,280 votes.

  • The vote count for the Golkar Party in the 4th Dapil of the Yapen Islands Regency in Papua Province's DPRD member allocation, establishing the correct vote count according to the petitioner for the Democratic Party, totaling 1,203 votes.

  • The vote acquisition for Nasdem Party and Perindo in the Heram District of Dapil 3 Jayapura City, is being returned according to the facts from the TPS.

The hearing for case No. 129-01-14-33/PHPU.DPR-DPRD-XXII/2024 was presided over by panel 2—Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani.
