JAKARTA, (MKRI) – The Constitutional Court (MK) held a preliminary hearing on the Dispute over the General Election Results for (Regional Legislative Council) DPRD Candidates in North Sumatra Electoral District (Dapil) 8 on Thursday May 2,2024 in the Preliminary Courtroom. Case No. 172-01-14-02/PHPU.DPR-DPRD-XXII/2024 was filed by the Democratic Party.
According to Jimmy Himawan, the petitioner legal counsel, two polling stations (TPS) had extra Hanura ballots. Hanura votes totaled 25 at TPS 1 and 1 vote at TPS 3, according to the petitioner Form C Results data.
The respondent's Form D showed 36 votes at the subdistrict level, he added. "The Hanura is gaining an excess of 35 votes." The petitioner feels that deliberate vote inflation for the Hanura is the reason for these 35 extra votes," he said.
The Hanura also gained 29 votes at TPS 1 and 28 votes at TPS 2 in Bintang Baru Village, Susua Subdistrict, South Nias Regency, from both polling stations, Hanura gained 57 votes.
The increase of votes at TPS 1 in Bintang Baru Village was due to discrepancies between the petitioner Form C.Results Copy, which should have shown 43 Hanura Party votes, and the respondent Form D.Results at the subdistrict level, which showed 72 votes. The Hanura Party has 29 extra votes. The petitioner claims these 29 extra votes are illegitimate due to Hanura Party vote inflation.
Thus, Hanura illegal vote inflation at these polling stations totaled 490 votes. Reporting this illicit vote inflation as Special Incident Notes and/or witness objections has been done.
Therefore, in the petitum, the petitioner requests the Court to annul the General Elections Commission (KPU) Decision No. 360 of 2024, specifically regarding the vote acquisition for the Gerindra, Indonesian Democratic Party of Struggle (PDIP), (Party of Functional Groups) Golkar, (People’s Conscience Party) Hanura, (National Democratic Party) NasDem in West Nias 1 for filling the positions of DPRD members of West Nias Regency and TPS 02 in Hilimberua Na'a Village, Sirombu Subdistrict, West Nias Regency.
