DPD NTB Candidate Calls for Disqualification of Ineligible Contenders

JAKARTA (MKRI) — TGH. Lalu Gede Muhamad Ali Wirasakti Amir Murni as a candidate for member of Electoral District (Dapil) of West Nusa Tenggara Regional Representative Council (DPD) has filed a petition over the 2024 DPR/DPRD (House of Representatives/Regional Legislative Council) election results to the Constitutional Court (MK). The hearing for case No. 05-18/PHPU.DPD-XXII/2024 was presided over by panel 2—Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani on Thursday (2/5/2024)

Through legal counsel, Suhardi, the Petitioner requests the Court to annul General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the 2024 legislative election results of the Presidential ticket, DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) announced nationwide on March 20, 2024 at 22:19 WIB as long as the votes obtained by the candidate number 11  for DPD RI member, Mirah Midadan Fahmid.

This is due to violations in the implementation process of the NTB DPD election, which resulted in the disqualification of the DPD candidate, Mirah, from the start of application. Mirah, in fulfilling the requirements for DPD NTB candidate is suspected of being registered as a voter outside the electoral district in question.

"The legislative candidate is registered at polling stations (TPS) 32, Biring Village, Roman, Manggala, Makassar City. By registering outside the election area, from the start the person concerned does not fulfill the requirements as a DPD candidate. In this case, the Respondent never made any corrections," said Suhardi from the Panel Courtroom. 

The Petitioner stressed that the votes were obtained for irresponsible reasons. Because there were many corrections in Mirah Midadan Fahmid's tabulation of recapitulation. Related to this argument, the Petitioner conveyed an example of vote acquisition as stated in D-Form West Lombok Regency results obtained by Mirah, namely 36,944 votes, with the final total of 265,246 votes. Meanwhile, the Petitioner received 18,944 votes with final acquisition being only 265,126 votes.

"It is legal for the DPD candidate number 11 in the name of Mirah Midadan Fahmid to be disqualified as he fails to meet the requirements stipulated in the relevant laws and regulations," stated Suhardi, while reading the third point of the petitum..
