JAKARTA, MKRI - The Crescent Star Party (PBB) filed a petition for the 2024 legislative election results of the Regional Legislative Council (DPRD) in Ogan Ilir Regency, Electoral District (Dapil) Ogan Ilir 5, South Sumatera Province to the Constitutional Court (MK). The Registrar’s Office of the Court registered PBB’s petition No. 268-01-13-06/PHPU.DPR-DPRD-XXII/2024. The preliminary hearing took place on Thursday, May 2, 2024 by Justices Panel 3 presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.

Petitioner’s legal counsel, Muhammad Rianu Pertama asserted that the certification of the vote results carried out by the General Elections Commission (KPU) as Respondent contained vote discrepancies between the Petitioner and the Respondent, causing losses for the Petitioner with the vote loss that should have been obtained. The Respondent certified that the PBB received 3,414 votes and the Great Movement Party (Gerindra) received 10,242 votes. Meanwhile, according to the Petitioner, the PBB Party should receive 3,428 votes and the Gerindra should receive 3,417 votes.

"The alleged fraud is due to the vote loss carried out by the Respondent at the Seri Kembang Village, Payaraman District, which occurred at Polling Stations (TPS) 06 Seri Kembang 1, 03, 05 UU, and 02 Seri Kembang III which were reduced or eliminated during the vote counting and recapitulation results, so it  will have an impact on the Petitioner's vote," said Rianu.

As a result of the Petitioner's vote loss, the Petitioner also lost the opportunity to obtain the 9th seat because the Petitioner's vote loss to the Gerindra by 3 votes, in the event that Gerindra won the second seat according to the Sainte Lague calculation method, while the Petitioner's vote was 3,414, Rianu explained.

In its Petitium, the Petitioner requests the Court to annul KPU Decree No.360 of 2024 for the Regency DPRD election in Ogan Ilir Regency.
