Ballots Damaged, PBB Asks for Revote in Batubara 6

JAKARTA, HUMAS MKRI - The Crescent Star Party (PBB) applied Dispute of the Results of the 2024 general election results dispute (PHPU) to the Constitutional Court (MK). Case No. 190-01-13-02/PHPU.DPR-DPRD-XXII/2024, PBB questioned the reduction of the petitioner’s votes in Simpang Kopi Village, Sei Suka Subdistrict, Batubara Regency.

The court presided over by Chief Justice Suhartoyo, Petitioner’s legal counsel Gatot Priadi stressed that the reduction of the Petitioner's votes in Simpang Kopi Village, Sei Suka Subdistrict, Batubara Regency, among others, occurred at Polling Stations 02 by 3 votes, Polling Stations 03 by 3 votes, Polling Stations 05 by 7 votes, Polling Stations 06 by 9 votes.

"The reduction of the Petitioner's vote was due to the Respondent's (KPPS Officer) error in calculating the vote which canceled the Petitioner's vote because there was a damaged ballot," said Gatot in the hearing held on Thursday (2/5/2024) in the Plenary Session courtroom.

The Petitioner argued that the Petitioner's votes were reduced in Kuala Tanjung Village. Sei Suka District, Batubara Regency, among others, occurred at polling station 01 by 1 vote, polling station 02 by 2 votes, polling station 03 by 2 votes, polling station 09 by 6 votes, polling station 21 by I vote. The reduction in the Petitioner's votes was due to the Respondent's error in casu Polling Station Working Committee (KPPS) Officers in counting the votes that canceled the Petitioner's votes because there were damaged ballots. 

Therefore, in his petition the Petitioner also explained that he had found in several polling stations there were unusual results of the General Election listed in the C Copy of the Results of the Regency/City DPRD and polling stations 16 and 19 in Kuala Tanjung Village, Sei Suka subdistrict, Batubara Regency. There is a polling station 16 in Kuala Tanjung Village as stated in the C Copy of the Results of the Regency/City DPRD written Number of Final Voters List (DPT) of 157 people and the number of ballots used as many as 157 sheets. "That means 100% of the DPT uses the right to vote," Gatot said.

For this reason, in his petitum, the Petitioner asks the Court to annul KPU decree Number 360 of 2024 as far as Batubara Election District 6 to fill Candidates for Members of the Batubara Regency DPRD in the 2024 General Election. 3. Determine the correct vote acquisition results according to the Petitioner to fill the members of the Batubara Regency DPRD in Batubara electoral district (dapil) 6.
