JAKARTA (MKRI) — Maluku Provincial Legislative Council (DPRD) candidate number 2 Agustinus Pical for the electoral district of Maluku 1 has filed a petition over the 2024 DPR/DPRD (House of Representatives/Regional Legislative Council) election results to the Constitutional Court (MK). The preliminary hearing for case No. 10-02-15-31/PHPU.DPR-DPRD-XXII/2024 took place on Tuesday, April 30, 2024, presided over by panel 2—Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani. However, the Petitioner and his legal counsels did not attend the hearing.

The Petitioner alleges that based on the General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the 2024 nationwide presidential and legislative election results (Provincial/Regency/City DPR, DPD, DPRD) announced on March 20, 2024 at 22:19 WIB, the total votes for the Indonesian Solidarity Party (PSI) were 10,502, while the National Awakening Party (PKB) received 10,753 votes.

The KPU (Respondent) certified 5,782 votes for the Petitioner, while the Petitioner alleges that he should have received 6,036. The margin was 254 votes. The KPU certified 6,027 votes for PKB legislative candidate Ary Sahertian, which the Petitioner believes should have been 6,018, with a margin of 9 votes.

In his petitum, the Petitioner requests that the Court annul the KPU Decree No. 360 of 2024 for the election of Maluku Provincial DPRD in Maluku 1 electoral district for TPS 08 of Teluk Ambon; TPS 14 of Posso, TPS 5 ofNusaniwe; and TPS 4 of Nusaniwe; order the accurate vote acquisition based on the Petitioner’s version for the election of Maluku Provincial DPRD in Maluku 1 electoral district where PSI received 10,770 votes; Agustinus Pical received 6,036 votes, PKB received 10,744 votes, and Ary Sahertian received 6,018 votes.
