PPP Aims for Fourth Seat in Sula Islands Regency Council

JAKARTA (MKRI) — The United Development Party (PPP) filed a petition to the Constitutional Court (MK) regarding the 2024 General Election Results Dispute (PHPU), after it was declared that they did not meet the parliamentary threshold of 4% by the Respondent (General Elections Commission - KPU). PPP is challenging the election results for members of the House of Representatives (DPR RI) in North Maluku and for members of the Regional Legislative Council (DPRD) in Sula Islands 4, North Maluku.

"The practice of illegally transferring of Petitioner's votes for the DPR election in the North Maluku Province to Garuda Party," stated the Petitioner's legal counsel, Irfan Maulana Muharam, in the Hearing Room of Panel Building 2 MK, Central Jakarta on Tuesday, April 30 2024.

PPP failed to meet the parliamentary threshold as it reportedly only secured 3.87 percent, approximately 193,088 votes short of reaching 4 percent. The Petitioner alleges that among this vote discrepancy, some of PPP's votes may have been unlawfully transferred to Garuda. This is based on the Petitioner's claims of margin in the vote count for PPP and the Garuda between the KPU's version and the Petitioner's version across 35 electoral districts in 19 provinces.

Among them, the Petitioner claims that 5,400 of PPP's votes were unlawfully transferred to the Garuda Party in North Maluku. This transfer was due to a counting error by the Respondent, resulting in the Petitioner's original tally of 13,795 votes being illegitimately reduced to 8,395 votes. Meanwhile, according to the KPU's version, Garuda gained 5,594 votes, whereas, in the Petitioner's version, Garuda obtained only 194 votes.

The Petitioner also highlights the differences in vote counts in the Sula Islands IV. According to KPU, the Party of Functional Groups (Golkar) received 1,067 votes while PPP obtained 1,060 votes. However, according to the Petitioner, Golkar received 1,057 votes, while PPP secured 1,065 votes.

In their Petitum, the Petitioner requests that the Court annul the KPU decision No. 360 of 2024 concerning the Certification of the 2024 General Election Results, specifically regarding the election results for the DPR RI members in the North Maluku and the DPRD members in the Sula Islands 4, as announced nationally on Wednesday, March 20, 2024, at 22:19 WIB,  The Petitioner also requests that the Court order KPU to establish the correct results for the DPR RI election in the North Maluku based on the petitioner’s correct vote count. 

The Petitioner also requests that the Court establish the correct vote tally according to the Petitioner for filling of DPRD Regency in Sula Islands 4. According to the Petitioner, PPP received 1,065 votes and Golkar 1,057 votes. Additionally, the Court is asked to instruct the KPU to allocate the fourth seat of the Sula Islands 3 DPRD Regency to PPP.

Alternatively, the Petitioner requests that the Court order KPU to conduct a recount at nine polling stations (TPS) in the Sula Islands Regency, including TPS 2 in Buruakol Village, TPS 1 in Paslal Village, TPS 2 in Capalulu Village, TPS 5 in Mangoli Village, TPS 5 in Waitina Village, TPS  2 in Naflo Village, TPS 1 in Waisakay Village, TPS 2 in Pelita Jaya Village, and Polling Station TPS2 in Waisum Village; and to order the KPU to allocate the fourth seat of DPRD Regency  in Sula Islands 3 to the Petitioner.

Case No 115-01-17-32/PHPU.DPR-DPRD-XXII/2024 was heard by Panel 2, presided over by the Deputy Chief Justice Saldi Isra, Ridwan Mansyur, and Arsul Sani. Justice Saldi emphasized that Justice Arsul continues to attend the sessions related to PPP to meet the quorum of justices. However, Justice Arsul exercised his right to abstain from deciding on cases related to PPP and did not engage in further examination or questioning of the parties involved.
