PKB Claims Vote Lost in North Halmahera DPRD

JAKARTA (MKRI) — The National Awakening Party (PKB) filed a petition for the 2024 General Election Results Dispute (PHPU) to the Constitutional Court (MK) to obtain seats as Regional Legislative Council (DPRD) members of the North Halmahera in North Maluku. PKB, as the Petitioner, argued that the margin in vote counting between the Petitioner and the Respondent (KPU) was detrimental to PKB by losing the seat that they should receive for the DPRD of North Halmahera Regency. 

According to the Petitioner, the votes margin was caused by the reduction of one vote for the PKB in Kao Teluk District. The reduction in vote happened since KPU was deliberately suspected in eliminating the vote for candidate number 3 on behalf of Clara Pureng on Form D of the Regency Results. Meanwhile, according to KPU, based on the District D-Results form in North Halmahera Regency for Dapil III, the PKB vote acquisition was 2,091 votes, whereas according to the Petitioner based on the Plano C-Results Form, Copy C-Results Form, and District D-Results Form, the votes of PKB is 2,092 votes. Based on the results of the recapitulation at the North Halmahera Regency level, there was a reduction of one vote for the Petitioner. 

Legislative Candidate Clara Pureng received one vote in Kao Teluk District, specifically at polling stations (TPS) 2 Dum-Dum Village based on Form C-Plano Results, Form C-Results Copy, and Form D-District Results. However, according to the Respondent, Clara Pureng received zero vote based on Form D-Regency Results in North Halmahera Regency.

In his Petitum, the Petitioner request the Court to annul KPU Decree No. 1098 of 2024 concerning the Stipulation of the General Election for DPRD Members on March 20, 2024 along with the results of the general election for North Halmahera Regency, Dapil III, Malifut District, Kao District, North Kao District, West Kao District, and District Kao Bay. They also request the Court to return the PKB votes that KPU had eliminated, and to determine the correct vote results according to the Petitioner with 2,092 votes and order the KPU to carry out a re-vote (PSU) at TPS 01 Makaeling Village, Kao Teluk District, and North Halmahera Regency.

The Court Registrar's Office registered the PKB application with No. 120-01-01-32/PHPU.DPR-DPRD-XXII/2024. This hearing in Panel 2 led by Deputy Chief Justice Saldi Isra, Ridwan Mansyur, and Arsul Sani.
