JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing on the election results dispute (PHPU) for Case No. 16-01-22-01/PHPU.DPR-DPRD-XXII/2024 filed by the Prosperous Justice Party (PAS Aceh), Tuesday (04/30/2024). The General Elections Commission (KPU) acted as the Respondent whereas the Great Movement Party (Gerindra Party) acted as the Relevant Party. The hearing was presided over by the Constitutional Justice Arief Hidayat, Anwar Usman, and Enny Nurbaningsih.
The PAS Aceh requested the Court to annul KPU Decree No. 360 of 2024 in the Aceh Province. During the hearing, through legal counsel Sayuti Abubakar, the Petitioner stated that there was a discrepancy in the vote count results between the Petitioner and the KPU (Respondent). According to the Petitioner, PAS Aceh should have acquired 16,923 votes, and the Gerindra Party should have acquired 14,935 votes. These results differ from those announced by the Respondent, where the Gerindra Party acquired more votes than PAS Aceh (19,069 votes).
"The difference in vote count results between the Petitioner and the Respondent was due to vote inflation for the Gerindra Party in Peurelak Timur Sub-district, where according to the C-Result and C-Result Copy in all polling stations (TPS) in that sub-district, the number of Gerindra Party valid votes were 444, both for the party and its candidates. However, based on the recapitulation by the sub-district election committee (PPK) and after the issuance of the D-Result for the Sub-district of Peurelak Timur, the number of Gerindra Party votes increased to 1008 votes. This means there were an addition of 564 votes," Abubakar continued.
In addition to the vote inflation in Peurelak Timur Sub-district, the difference in vote count results between the Respondent and the Petitioner was also caused by the Gerindra Party acquiring inflated votes in Peurelak Barat Sub-district. According to the C-result and C-result Copy in all TPS, the Gerindra Party acquired 180 valid votes. However, after the vote recapitulation by the PPK and issuance of the D-result form, the number of ballots acquired by the Gerindra Party increased to 1,204. This means there was an increase in votes for the Gerindra Party by 1,024 votes.
At the hearing, the Petitioner presented the Petitum where they requested the Court to annul KPU Decree No. 360 of 2024 of Electoral District (Dapil) Aceh 6 for the appointment of DPR Aceh members. Additionally, the Petitioner wished that the Panel of Justices would stipulate the correct vote count result deemed accurate by the Petitioner, as identified 89,511 votes for the Aceh Party, 21,664 votes for the Nasdem Party, 17,997 votes for the PKB, 16,923 votes for PAS Aceh, 16,140 votes for the Golkar Party, and 14,935 votes for the Gerindra Party.
