JAKARTA (MKRI) - A preliminary hearing on the Dispute over the General Election Results for Legislative Members of West Java Electoral District (dapil) Cirebon 2 was held in the Constitutional Court (MK) Plenary Courtroom on Tuesday (04/30/2024). PAN filed case No. 74-01-12-12/PHPU.DPR-DPRD-XXII/2024.
RD Susanti Komalasari, representing the petitioner, stated in the hearing chaired by Chief Justice Suhartoyo that the petitioner vote acquisition had decreased by four votes, which significantly affected the petitioner's capacity to win seats on the City Council of Cirebon in West Java in the dapil of Cirebon City 2.
She stated, "The recapitulation results show fewer votes in the Lemahwungkuk Subdistrict. The polling station working committee (KPPS) of the Lemahwungkuk subdistrict election committee (PPK) declared valid votes invalid/damaged in dapil of Cirebon City 2. Two Lemahwungkuk Subdistrict polling stations, TPS 14 in Panjunan Village and TPS 62 in Pegambiran Village, lost votes. "The respondent clearly disadvantaged the petitioner."
The petitioner's votes decreased after the KPPS and PPK of Lemahwungkuk Subdistrict conducted a Cirebon City Council Recount of Ballot Votes on Wednesday, February 21, 2024, around 2:00 PM at PPK Lemahwungkuk, Panel Panjunan, TPS 14, Panjunan Village. One valid ballot was damaged due to a tear at the fold that was not on the Party Logo, Serial Number, or Candidate Name. The ballot was marked for National Mandate Party Candidate Number 1 (Soebagdja Salim), but KPPS TPS 14 Chair Hamid declared it damaged and not counted.
PAN still received 5 votes according to TPS 14 Panjunan C1 form. If the ballot declared damaged by the KPPS Chair was valid, PAN would have 6 valid votes at TPS 14 Panjunan.
Susanti explained “during PPK Lemahwungkuk recapitulation in Panjunan subdistrict Panel TPS 14. The Petitioner Witness believes a torn ballot at the top fold is valid. However, The KPPS 14 Panjunan head, Mr. Hamid, crossed out the ballot paper as damaged.”
The petitioner's witness learned from KPPS TPS 62 member Angga Permana that three PAN ballots were invalid due to fold tears during PPK Lemahwungkuk's Recapitulation at Panel Kelurahan Pegambiran TPS 62. After reviewing the information, the petitioner's witness requested a Recount of Votes at TPS 62, Pegambiran Village.
Witness Objections During Recapitulation
According to the Petitioner. The petitioner's witness, Dani Mardani, protested and objected during the vote count recapitulation at the Regional Elections Commission (KPUD) of Cirebon City, and the petitioner requested a Recount of Votes for TPS 14 Panjunan and TPS 62 Pegambiran Village, but the respondent denied it, citing that the Plenary of Commissioners of the KPU had refused the petitioner's balloting stations.
Susanti continued that the juridical facts indicated that the respondent violated laws laws and regulations by removing valid PAN votes, which disadvantaged PAN, as revealed in the plenary meeting of the KPU of Cirebon City.
Based on these facts, we request the MK, which examines and settles the aforementioned case, to kindly annul the respondent's Certification and request the respondent to establish the correct vote acquisition for the City Council of Cirebon candidate positions in the dapil of Cirebon City 2.
