JAKARTA (MKRI) – The National Mandate Party (PAN) has filed a petition for the election results dispute (PHPU) for the 2024 election of the House of Representatives (DPR) and Regional Legislative Council (DPRD). On case No. 05-01-12-38/PHPU.DPR-DPRD-XXII/2024, PAN questions the vote count for DPRD/DPRA (Legislative Council) of the Southwest Papua Province, in electoral district (Dapil) of Southwest Papua 3.
The preliminary hearing of this case was presided over by the Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih on Tuesday, April 30, 2024 at the Court. Legal counsel Azam Midan stated that the Petitioner objects to the results of the vote count in Southwest Papua 3 as certified by the Respondent in accordance with Model C-Results (copy forms) and Model D-Results. The reason is because there are allegations of fraud and / or violations that are detrimental to the vote acquisition of the Petitioner. The fraud occurred in Southwest Papua 3 at polling station 07 and 018 Lalawele Village, Aimas District, Sorong Regency, Southwest Papua Province.
"The Petitioner objects to the election results certified by the KPU (General Elections Commission) as the Respondent in connection with the existence of candidates who served as KPPS (polling station working committee) members in Electoral District of West Papua 3, polling stations 07 and 18 Malawele Village, Sorong Regency," said Azam Midan.
The petition also explained that at polling station 07 Mlawele Village, a candidate Number 2 of the Prosperous Justice Party (PKS) Number 2 from Sorong 3 served as KPPS Chairperson. Then, at polling station 18 Malawele Village, a candidate Number 2 from PKS from Sorong 2 served as a KPPS member.
Regarding the existence of candidates who concurrently serve as KPPS members, it is not in line with the basic ethics and behaviors in the code of ethics for organizing elections. Thus, the Petitioner used this reason as evidence of fraudulent practices and / or violations that are clearly and obviously committed by the Respondent as the Election Organizer.
Furthermore, referring to the recapitulation of vote count D-Results, the 7th seat or the last seat in Southwest Papua 3 was obtained by the People’s Conscience Party (Hanura), which was only two votes different from the Petitioner's vote. For this reason, the Petitioner believes that it is necessary to recount the votes at polling stations that are known to have experienced fraud.
In the Petitum, the Petitioner requests that the Court cancel KPU Decree No. 360 of 2024 related to the case and order the Respondent to conduct a re-voting at polling stations 07 and 018 Malawele Village, Aimas District, Sorong Regency, Southwest Papua Province.
