JAKARTA (MKRI) – The Constitutional Court (MK) of the Republic of Indonesia held a preliminary hearing for Case no. 25-02-08-01/PHPU.DPR-DPRD-XXII/2024 on the 2024 Election Results Disputes (PHPU) filed by Muhammad Yusuf, Tuesday (30/4/2024). This hearing was presided over by the Constitutional Justice Arief Hidayat, Anwar Usman and Enny Nurbaningsih.

Muhammad Yusuf (Petitioner) was a Candidate for the North Aceh Regency Legislative Council in Electoral District (Dapil) IV representing the Prosperous Justice Party (PKS). Despite being present at the hearing without legal counsel, he objected and rejected the vote count results stipulated by the General Election Commission (KPU) in Dapil IV of North Aceh. This objection arises from the absence of certain C-1 forms. There are allegations of vote manipulation from candidate No. 7 to other candidates in accordance with testimony and evidence from witnesses at each polling station (TPS), allegedly coordinated by certain individuals. Essentially, election fraud and violations are criminal offenses under Article 26 Paragraphs 2, 3, and 4 of Law No. 7 of 2017 on Elections, which governs structured, systematic, and massive election violations.

However, during the hearing, it was disclosed that the petitioner did not grant recommendation or approval from the PKS Executive Board (DPP).

“In individual disputes, the Petitioner should have the approval and recommendation from their party's Central Executive Board (DPP) first," said Constitutional Justice Arief Hidayat. Therefore, the hearing could not be proceeded since the formal requirements of the petition were not met.
