JAKARTA, MKRI - The Constitutional Court (MK) held a preliminary hearing on the election results dispute (PHPU) for Case No. 54-01-05-01/PHPU.DPR-DPRD-XXII/2024, Tuesday, April 30, 2024. The Petitioner was filed by the National Democratic Party (NasDem) for the election of the House of Representatives (DPR), the Regional Legislative Council (DPRD), Provincial/DPRA (Aceh Legislative Council), Regency/City DPRK (Aceh Legislative Council) in Pidie Jaya Regency, Aceh Province. The hearing presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.
Petitioner’s legal counsel, Parulian Siregar asserted that the calculation results at each polling station (TPS) in Bandar Baru Sub-district in accordance with Model C-Results Forms, the Aceh Party's votes were 13,828 votes. However, what was recorded in the General Elections Commission (KPU) results were 14,944 votes.
"There were discrepancies of 1,116 votes received by the Aceh Party. The discrepancy occurred during the recapitulation result in Bandar Baru Subdistrict, Electoral District (Dapil) III Pidie, which has 1 sub-district. This result caused the Petitioner not to receive victory in Pidie Jaya 3," Parulian explained.
The discrepancy had been reported to the Elections Supervisory Body (Bawaslu) and a direction had been given to conduct a vote recapitulation. However, Bawaslu's direction was not implemented by the Independent Election Commission (KIP) of Pidie Jaya Regency.
If the vote recount for DPRK candidates based on TPS C-Results Forms in Bandar Baru Sub-district has been carried out, the vote acquisition for the Aceh Party will be reduced. This could increase the potential seats for the NasDem in DPRK Pidie Jaya 3. Therefore, in the Petitum, the Petitioner requests the Court to cancel the KPU Decree related to the case a quo and certify the correct vote acquisition results according to the Petitioner.
